Why Action is Necessary

An amendment to an ILA for the Broward Redevelopment Program (“BRP”) requires approval by the Board of County Commissioners (“Commission”).

 

What Action Accomplishes

Approves the Third Amendment to an ILA between the County, the City of Fort Lauderdale (“City”), and the Fort Lauderdale Community Redevelopment Agency (“CRA”), retroactively extending the term by one year to terminate on December 31, 2026.

Previous Action Taken

The Commission originally approved the ILA at the March 5, 2019, meeting (Agenda Item No. 7), the First Amendment on November 15, 2022 (Agenda Item No. 30), and the Second Amendment on April 1, 2025 (Agenda Item No. 30).

 

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING FINANCE AUTHORITY RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Commission’s Value of “ensuring residents have an affordable place to live by offering sustainable, compatible, innovative, accessible, affordable housing options for all income levels, including integrated, permanent supportive housing and zoning that helps residents build equity."

 

On March 5, 2019, the Commission approved a motion (Agenda Item No. 7) authorizing the County to enter into an ILA with the City and the CRA to fund the construction of a Complete Streets Project on Northeast 4 Avenue, from Sunrise Boulevard to Northeast 13 Street, in the area depicted in Exhibit 3, as part of the BRP.  The original ILA provided for a termination date of December 31, 2022, which was amended by the Commission on November 15, 2022, (Agenda Item No. 30) and extended the ILA termination date to December 31, 2024, to enable completion of the project. A second amendment to the ILA was approved on April 1, 2025 (Agenda Item No. 30), extending the termination date to December 31, 2025, so that the City could complete the installation of light poles, which was the only unfinished aspect of the scope of work. The original project award was $1,000,000.  To date $333,333 have been remitted to the City. At the conclusion of the project the remainder of the project grant will be remitted.

 

County staff received a letter dated December 18, 2025, (Exhibit 2) indicating that commencement of the lighting installation requires amendment to an existing agreement with the Florida Department of Transportation to incorporate this activity into the approved scope and will delay the project beyond the termination date of the ILA with Broward County.  Therefore, the City requires another extension to the termination date of the ILA to complete the full scope of work of the BRP grant.  Once the requisite approvals are obtained, completion of the lighting work is expected to take approximately one week.

 

This Third Amendment is intended to be the last and final extension of the ILA. No further extensions will be granted. Any BRP grant funds remaining unspent as of the termination date of December 31, 2026, shall be decommitted and returned to the County in accordance with the terms of the ILA.

 

The project is in compliance with the public purpose of removing blighting conditions in the Central City CRA area and furthers the City’s Vision of becoming a connected and multimodal community. The Office of the County Attorney has approved the Third Amendment (Exhibit 1) as to form, which retroactively extends the ILA term by one year, from December 31, 2025, to December 31, 2026.
