Why Action is Necessary

MOTION A: Transfers from reserve and increase a capital project more than 5% require approval by the Broward County Board of County Commissioners.

 

MOTION B: In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that include a single bidder, rejection of apparent low bidder, protested award, or pulls from the Board regarding the intended award.

 

MOTION C: In accordance with the Broward County Procurement Code, Section 21.56, Change Orders-Construction Contracts, Board approval is required for a change order allowance of more than 5%.

 

What Action Accomplishes

Motion A: Provides funding for the costs of construction that are in excess of what was budgeted and 5% additional change order allowance for unforeseen conditions related to performing construction while minimizing disruptions to daily operations.

 

Motion B: Provides for the construction of the second floor to relocate the Security Operations Data Center from ground level to a higher elevation.

 

Motion C: Provides for a change order allowance of 10% of the total contract amount.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT/SEAPORT ENGINEERING AND CONSTRUCTION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

The Office of Economic and Small Business Development (OESBD) determined that no County Business Enterprise (CBE) participation goal should apply to this solicitation based on the funding source and applicability of federal procurement requirements which, at the time of this determination, prohibited the use of statutorily or administratively imposed in-State or local geographic preferences in the evaluation of bids or proposals (Exhibit 3).

 

The purpose of this contract is to perform all services associated with the construction of a second floor to the existing Port Everglades Security Operations Center Building to mitigate risks by relocating the Security Operations Data Center from ground level to higher elevation.

 

This procurement carries a 100% performance and payment guaranty(s). The recommended vendor, Franjo Builders LLC, has provided a bid guaranty obligating the vendor to provide requisite performance and payment guaranty(s), upon award.

 

The Director of Purchasing determined the apparent low bidder, Acceptable Painting Unlimited, LLC, to be non-responsive to the solicitation requirements for failure to bid on all line items.

 

The Seaport Engineering and Construction Division reviewed the bid submitted by the low responsive, responsible bidder, Franjo Builders LLC, and concurs with the recommendation for award (Exhibit 4).

 

No County vendor performance evaluations have been completed for Franjo Builders LLC.

 

The Purchasing Division reviewed the prices submitted by the low responsive, responsible bidder, Franjo Builders LLC, and determined that the prices submitted are fair and reasonable (Exhibit 5).

 

The bid was advertised on May 19, 2025, and opened on June 25, 2025; six bids were received with no declinations (Exhibit 2).

 

The Recommendation for Award was posted on the Purchasing Division website from August 13 - 19, 2025. There was no protest filed against this procurement.

 

At the time of solicitation opening, Franjo Builders LLC’s submittal included a copy of their original bid bond in the amount of 5% of the bid amount. Although Franjo Builders LLC did not physically provide an original bid bond at the time of solicitation opening, Franjo Builders LLC provided the original bid bond on June 30, 2025. In accordance with the Broward County Procurement Code, Section 21.37.(b), Acceptance of responses and waiver of technicalities or irregularities, the Director of Purchasing approved the waiver of technicality on July 17, 2025.
