Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives” and the Goal of “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”
On November 15, 2016 (Item No. 3), the Board approved an Interlocal Agreement with the Florida Department of Transportation (“FDOT”) for the installation, operation, maintenance, and repair of nine traffic sensors to monitor traffic flows and patterns within the Port Everglades Jurisdictional Area. The Agreement was fully executed by FDOT on December 9, 2016. The original Agreement provided for annual operation and maintenance payments by County to FDOT in the amount of $25,000, beginning October 1, 2017, and continuing through September 30, 2024. While the original Agreement provided that the Agreement could be renewed for an additional eight-year term at the same terms and conditions, FDOT recently advised staff that they were unable to commit to the renewal, but were willing to extend the agreement for one additional year at a cost of $50,000 for operation and maintenance of the system while the County pursues a separate contract with a private entity to operate and maintain the system.
One of the primary purposes of this traffic monitoring is to collect data to evaluate the impact of cruise and cargo operations on Port roadways and access points, and for long term planning. The continuous traffic sensor data allows port staff to better understand the variation of traffic loads by vehicle type, is useful for determining the feasibility of potential surface transportation improvement strategies such as modifying traffic light timing to reduce congestion and vehicle idling and helps evaluate the need for road improvements at the Port.
Since County staff and FDOT are still finalizing the amendment language, the motion approves the substantial form of the amendment and delegates authority to the Port Everglades Chief Executive/Port Director to execute the amendment when final with only non-substantive changes and subject to review by the Office of the County Attorney for legal sufficiency.

The County’s share for operations and maintenance cost is $50,000, which will be provided as reimbursement to FDOT. Funding is available in the approved Port Everglades Fiscal Year 2025 Operating Budget.
