Why Action is Necessary

A. Board of County Commissioners (“Commission”) approval is required to approve and execute lease agreements and amendments to lease agreements.

 

B. Commission approval is required to approve and execute lease agreements and amendments to lease agreements.

 

C. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approved by the Commission.

 

What Action Accomplishes

Approval of Motion A modifies the lease Agreement between Broward County and Broward Partnership for the Homeless, Inc., d/b/a Broward Partnership (“BPHI”) for the Central Homeless Assistance Center (“CHAC”) to reflect the new agreement number for the operation of the CHAC.

 

Approval of Motion B modifies the Lease Agreement between Broward County and BPHI for the North Homeless Assistance Center (“NHAC”) to reflect the new agreement number for the operation of the NHAC.

 

Approval of Motion C waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE HOUSING OPTIONS, SOLUTIONS, AND SUPPORTS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.”

 

On November 5, 2019 (Item No. 12), the Commission approved Agreement No. 19-CP-HIP-8470-01 (“Operating Agreement”) between Broward County and BPHI (“Parties”) for the provision of emergency shelter and support services at the CHAC and the NHAC for individuals and families experiencing homelessness in Broward County.

 

On September 5, 2024 (Item No. 9), the Commission approved the new operating Agreement for the CHAC and NHAC, and the Parties subsequently entered into the new Agreement, effective October 1, 2024, Agreement No. 25-HOSS-HIP-8666-01, ending September 30, 2029.

 

The proposed Amendments will update the reference of the Operating Agreement to reflect the new agreement number for the operation of the CHAC (Exhibit 1) and the NHAC (Exhibit 2), effective October 1, 2024.

 

Retroactive approval is requested to align with the effective date of the new Operating Agreement.

 

The Amendments have been reviewed and approved as to form by the County Attorney’s Office.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer… shall have or hold any employment or contractual relationship with any business entity… which is… doing business with an agency of which he or she is an officer or employee.” In accordance with Section 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion C) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached as Exhibit 3 and constitutes full disclosure of any existing conflicts.
