Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION, AND PORT EVERGLADES DEPARTMENT, RECOMMEND APPROVAL OF THE ABOVE MOTION.
The property is located at 9601 Orange Drive, Davie, Florida 33328, identified by folio number 5041-29-01-0290, and consists of approximately five acres. The proposed purchase price of the property is $3,000,000. There will also be typical closing costs in addition to the purchase price. As required in Section 6.122(k) of the Broward County Administrative Code, two appraisals of the property were obtained. The proposed purchase price exceeds the average appraised value; therefore, an extraordinary vote is required to approve the purchase.
The Purchase and Sale Agreement (“Agreement”) provides for a customary inspection period. During the inspection period, the County, at its sole cost and expense, will obtain a survey and conduct inspections and an environmental assessment, which are on an accelerated timeline relative to our typical agreements due to the lack of development on the property. The County has the option to terminate the Agreement under various circumstances as provided for in the Agreement, including, among others, if the Seller defaults on its obligations under the Agreement and if the Seller is unable to provide clear title to the Property.
All documents have been reviewed and approved as to legal sufficiency by the Office of the County Attorney.
