Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.42.(j), Procedures for RFPs, RLIs, and RFQs, if a protest has been filed with respect to an Evaluation Committee’s ranking, the ranking must be submitted to the Board for final approval. The Board, by majority vote, may (1) accept the ranking as final; (2) reject all responses to the solicitation; or (3) direct the Evaluation Committee to reconvene to consider any new or additional information the Board directs the Evaluation Committee to consider. In addition, the Board may request presentations by the ranked vendors and may, by supermajority vote, re-rank those vendors in a final ranking.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 20% for this solicitation. Moss and Associates, LLC submitted a Contractor’s Assurance Statement, which has been reviewed and approved by OESBD (Exhibit 2).

 

This solicitation provides for managing general contractor (MGC) services to construct a new Forensic Science Center (FSC), to house the Broward County Office of the Medical Examiner and Trauma Services (OMETS) and Broward Sheriff’s Office (BSO) Crime Laboratory. The FSC will be located at:  2000 West Commercial Boulevard, Fort Lauderdale FL 33309. The FSC is estimated size of 180,000 gross square feet. The MGC project will be managed by the Construction Management Division.

 

The RFP was advertised on March 17, 2026, and, at the time of the submittal deadline on April 23, 2026, seven firms submitted proposals: Expressions for You, Corp.; Moss and Associates, LLC; NV2A Gulf JV; OHLA Building, Inc.; Suffolk Construction Company, Inc.; The Whiting-Turner Contracting Company; and Turner Construction Company.

 

On July 18, 2026, an Initial Evaluation Committee (EC) meeting was held. The Evaluation Committee determined that six firms were both responsive and responsible to the RFP requirements and one firm was determined non-responsive and responsible. The Evaluation Committee shortlisted the six firms to advance to final evaluation, which includes vendor presentations, question-and-answer period, numerical scoring, and ranking.   

 

On August 10, 2026, a Final EC meeting was held. After presentations, evaluation, scoring and ranking, the Evaluation Committee named Moss and Associates, LLC as the first-ranked firm; Turner Construction Company as the second-ranked firm; NV2A Gulf JV as the third-ranked firm; The Whiting-Turner Contracting Company as the fourth-ranked firm; Suffolk Construction Company, Inc. as the fifth-ranked firmed; and OHLA Building, Inc. as the sixth-ranked firm (Exhibit 1).

 

The Evaluation Committee’s proposed recommendation of ranking was posted on the Purchasing Division website from August 13 - 17, 2026, providing an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. No objection was received.

 

The EC’s final recommendation of ranking was posted on the Purchasing Division website from August 18 - 24, 2026, which provided an opportunity for any aggrieved proposer to file a formal protest.

 

On August 24, 2026, the Director of Purchasing received a timely filed protest letter from Turner Construction Company (“Turner”) to the final recommendation of ranking (Exhibit 3). The protest’s exhibits, A-G, are available upon request. 

 

On September 16, 2026, the Director of Purchasing issued a response to Turner Construction Company stating that, upon careful consideration of all protest assertions to Final Recommendation to Ranking, evaluation of the responses received, and in consultation with the Office of the County Attorney, the established guidelines, practices, and procedures set forth in the Broward County Procurement Code, Ordinances, and existing written guidelines, the protest filed by Turner was denied. (Exhibit 4).
