Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board’s goal of Accountable Government by “providing an open government that is transparent and accessible to the public.” It also supports the Go Green goals by creating a process that “reduces waste” and “furthers sustainability in government operations.”

Broward County Zoning Code is maintained digitally through Municode. However, Section 39-11 of the Code still requires staff to have paper zoning maps on file for public use. For several years zoning data had been made accessible, through the Urban Planning Division’s webpage, in an easy to search format for property owners and developers. The proposed code amendment would discontinue the paper zoning maps.

Section 39-74(b) of the Zoning Code currently entitles nonconforming plots located within residential zoning districts to construct a minimum of one dwelling unit. The proposed amendment would permit construction consistent with the applicable zoning category on nonconforming plots located within residential zoning districts.

Multiple sections of the Zoning Code define and regulate community residential homes and assisted living facilities. The proposed amendment would update these sections to be consistent with site selection requirements of Section 419.001, Florida Statues. Finally, the proposed code amendment would provide for general updating amendments to the Zoning Code.
