Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.
Broward County and Palm Beach Aggregates entered into Agreement for Capacity Allocation in Phase 1 of the C-51 Reservoir Broward County, Florida, Agenda Item No. 77 on March 14, 2017, (“Agreement”) to purchase an allocation in the Phase I of the C-51 Reservoir, which will include 14,000 acre-feet of storage capacity. The Agreement requires that Palm Beach Aggregates will transfer ownership of Phase I of the C-51 Reservoir to C-51 Reservoir, Inc., a Florida not-for-profit corporation., ("C-51 NFP"). Pursuant to the C-51 corporate bylaws, water utilities that are governmental entities, and that have executed an agreement for capacity allocation, are entitled to appoint one representative each on the C-51 NFP Board of Directors.
If approved, this item will appoint the Director of Water and Wastewater Services as a Director (“Director”) on the C-51 NFP Board of Directors, enabling the County to vote on matters affecting C-51 Phase I Reservoir system operations. Currently, the C-51 NFP bylaws do not allow for the appoint of alternate representatives, but it is anticipated that the bylaws will be amended to allow for alternates. Therefore, this item also authorizes the Director to appoint an alternate in the event of Director’s absence.
