Why Action is Necessary
In accordance with Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.
In accordance with Florida Statutes Section 332.0075(3)(b), a governing body must approve, award, or ratify contracts for the purchase of commodities or contractual services executed by or on behalf of a large hub airport in an amount that exceeds $1,500,000 as a separate line item on the agenda and must provide a reasonable opportunity for public comment. Such contracts may not be approved, awarded, or ratified as part of a consent agenda.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) reviewed the scope of work and did not assign County Business Enterprise (CBE) goals pursuant to the Broward County Business Opportunity Act Section 1-81.3(a)(1)a, which states that if there are fewer than two certified CBEs available to participate in a specific project, no CBE goal will be applicable (Exhibit 2).
The purpose of this contract is to provide automatic door repairs and maintenance services for the Aviation Department and other County agencies on an as-needed basis. All prices, terms, and conditions will remain fixed for the initial one-year contract period. Upon completion of the initial contract period, the contractor may make a timely request for an annual price adjustment, prior to the renewal date, for years two through five, in accordance with the price adjustment clause term of the contract.
In accordance with the Broward County Living Wage Ordinance, Broward County Administrative Code Section 26-101(i), as amended, these services are covered services. Oratso Corporation has agreed to be bound to the contractual obligations of the Living Wage Ordinance, which includes the minimum wage rate, employee health care benefits, and paid time off.
In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code Section 19.211, these services are subject to the Workforce Investment Program. Oratso Corporation has agreed to be bound to the contractual obligations of the Workforce Investment Program.
The allowances in this contract include an annual amount of $120,000 for miscellaneous parts and $11,000 for permit fees. These allowance items must be approved by the contract administrator prior to purchase and will be reimbursed at the contractor's actual incurred cost, without mark-up.
The Aviation Department has reviewed the bids submitted by Oratso Corporation and concurs with the recommendations for award (Exhibit 3). One vendor performance evaluation was completed for Oratso Corporation; the firm has an overall performance rating of 2.58 out of possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.
The Purchasing Division reviewed the prices submitted by the recommended low bidder, Oratso Corporation, and determined that the prices submitted are fair and reasonable and aligned with current market analysis for these services (Exhibit 4).
The contract consists of the County’s bid solicitation and the vendor’s response to the solicitation.
Incumbent: Oratso Corporation, Contract Number and Title: BLD2122199B1_1, Automatic Door Repair & Maintenance, Contract Term: August 1, 2021 through October 29, 2023. Expenditures to date: $292,592.
The bid was posted on June 26, 2023 and opened on July 28, 2023; two bids were received with no declinations (Exhibit 1).
The Recommendation for Award was posted on the Purchasing Division website from September 13 - 20, 2023, at which time any aggrieved vendor could have protested the results. No protest or appeal was filed regarding this procurement.
The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
The initial contract period shall begin on October 29, 2023 and shall terminate one year from that date.
