Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION

RECOMMENDS APPROVAL ON THE ABOVE MOTIONS.

 

The Office of Economic and Small Business Development established a County Business Enterprise (“CBE”) participation goal of 30% for entirety of FGMP No. 8 work.

 

On September 22, 2020, the County Administrator executed, through Board Action on September 10, 2020 (Item No. 59), the Agreement for Managing General Contractor with the SPJV (“Construction Agreement”) to engage the construction services of the SPJV for certain Broward County judicial projects identified in County’s solicitation PNC2119163P1.

 

On September 21, 2021, the Board approved a First Amendment to the Construction Agreement that increased the funding to the Owner’s Allowance accounts for the projects to allow the County the flexibility, as necessary, to address fluctuations in the pricing of construction costs resulting from the ongoing pandemic.

 

On October 11, 2022, the Board approved a Second Amendment to the Construction Agreement that set the Estimated Guaranteed Maximum Price for the South Regional Courthouse Replacement Project.

 

On April 16, 2024, the Board approved a Third Amendment to the Construction Agreement that set forth specific enabling projects necessary to be completed prior to the start of construction of the 500-Car Secured Parking Garage and Plaza project and established an Estimated Guaranteed Maximum Price of $14,708,910.

 

On May 1, 2024, the Contract Administrator approved the first phase of the enabling projects for the 500-Car Secured Parking Garage and Plaza project (“Garage Enabling Projects”), FGMP Contract Amendment No. 8A for preparatory work, in the amount of $2,510,413.

 

On July 9, 2024, the Contract Administrator approved the second phase of the Garage Enabling Projects, FGMP Contract Amendment No. 8B for abatement of the Central and West Buildings, in the amount of $8,130,390.

 

This proposed third phase of the Garage Enabling Projects, FGMP Contract Amendment No. 8C, allows for the demolition of the Central and West Buildings and the reconstruction of the East Building west facade. This negotiated FGMP No. 8C totals to $17,597,743.

 

Motion A approves FGMP Contract Amendment No. 8C in the amount of $17,597,743 and establishes an increased total FGMP for all FGMP No. 8 work. The total FGMP for the Garage Enabling Projects is established as $28,238,546 and allows for the full performance of the work without disruption.

 

FGMP Contract Amendment No. 8C has been reviewed and approved as to form by the County Attorney’s Office.

Fiscal Impact/Cost Summary

The revised total projected cost of the Garage Enabling Projects, inclusive of the entire FGMP No. 8, is approximately $29,979,490. The Board approved total budget for this project is currently $20,149,750. The balance of funds needed for the Garage Enabling Projects is $9,829,740.

 

The Garage Enabling Projects must be completed prior to the start of construction of the 500-Car Secured Parking Garage and Plaza project. Consequently, the additional $9,829,740 is proposed to be transferred from the 500-Car Secured Parking Garage and Plaza project to fully fund the Garage Enabling Projects in the total amount of $29,979,490, which includes funding for budgeted expenses in addition to SPJV’s construction costs.
