MOTION TO AUTHORIZE County Administrator to amend the Broward County HUD Five Year Strategic Consolidated Plans for Fiscal Years 2020-2024 and the accompanying Annual Action Plans for the U.S. Department of Housing and Urban Development ("HUD") Community Planning and Development Grants; to make necessary project/activity eligibility and programmatic changes; reprogramming funds and revising the HOME Investment Partnership Program Grant (“HOME”), based on the recommendations in Exhibit 1; authorizing the County Administrator to take all necessary administrative and budgetary actions for implementation of the changes, to submit a copy of the amendment to HUD, and to negotiate and execute agreements, amendments, reinstatements, and interlocal agreements with subrecipients, and/or contractors/developers to implement the programs and allocate funding for the respective programs, subject to the review and approval as to legal sufficiency by the Office of the County Attorney.

Why Action is Necessary
Board approval is required to amend Broward County HUD Five Year Strategic Consolidated Plans and accompanying Annual Action Plans to reprogram/reallocate funding and priorities, implement substantial changes, execute agreements and amendments to implement such changes, and subsequently execute agreements with other municipalities, agencies, and vendors.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Board's value: "Ensuring residents have an affordable place to live by offering sustainable, compatible, innovative, accessible, affordable housing options for all income levels, including integrated, permanent supportive housing and zoning that helps residents build equity”.
This motion allows the County to make the necessary changes to the Broward County HUD Five Year Strategic Consolidated Plans and accompanying Annual Action Plans (AAP), make necessary regulatory, project eligibility and programmatic changes, and subsequent budgetary and administrative actions detailed in Exhibit 1.
HOME Investment Partnership Program
The projects identified in Exhibit 1 were originally included in the approved HUD Annual Action Plans for Fiscal Years 2020 through 2024 and were subsequently awarded by the Broward County Board of County Commissioners (BOCC) between Fiscal Year 2022/2023 through Fiscal Year 2024/2025.
Broward County receives HOME funding from HUD as the Lead Entity of the Broward County HOME Consortium, which includes 11 participating municipalities: Coconut Creek, Coral Springs, Davie, Deerfield Beach, Lauderhill, Margate, Miramar, Pembroke Pines, Plantation, Sunrise, and Tamarac. Establishment of a HOME Consortium is required by HUD to enable coordinated receipt and administration of HOME funds.
During the Fiscal Year 2022/2023 through 2024/2025 Annual Action Plans, the City of Pembroke Pines (“City”) included a HOME strategy to assist first-time homebuyers through purchase assistance activities/projects. Due to increasing property values and property value restrictions, fluctuating interest rates, and other market constraints, the City has experienced difficulty in expending these funds. As a result, the HOME funds are approaching commitment and expenditure deadlines, placing them at risk of recapture by HUD. As the Consortium’s Lead Entity, the County recommended reallocating these unexpended funds to support a multi-family affordable housing rental strategy in partnership with the South Florida Community Land Trust (SFCLT). The proposed project is the acquisition of a 12-unit multi-family building (one-bedroom, one-bathroom units) located in the City. The project will serve qualified very low and low-income households and will remain permanently affordable under the terms of the HOME Program.
On October 15, 2025, the Pembroke Pines City Commission approved the partnership and the reallocation of funds to Broward County’s Housing and Urban Planning Division (HUPD) as proposed in Exhibit 1 attached hereto. See Agenda Item 2025-R-43 (Exhibit 2).
The SFCLT was originally awarded Fiscal Year 2024/2025 HOME Community Housing Development Organization (CHDO) set-aside funds through the County’s Notice of Funding Availability (NOFA) process. SFCLT is also recommended for additional CHDO set-aside funding for Fiscal Year 2025/2026. Initially, these funds were designated for the rehabilitation of ten existing affordable housing units and the acquisition/rehabilitation of four single-family homes. However, SFCLT secured alternative funding for those projects, freeing up the Fiscal Year 2024/2025 and the Fiscal Year 2025/2026 HOME CHDO allocations.
SFCLT has requested approval to reallocate the Fiscal Year 2024/2025 and Fiscal Year 2025/2026 HOME CHDO funds toward the proposed acquisition project identified in Exhibit 1 attached hereto. This reallocation will allow SFCLT to acquire the building with minimal debt, leveraging private financing for rehabilitation costs, and resulting in the creation of 12 new permanently affordable rental units.
Both the County and the City have satisfied HUD’s citizen participation and public notice requirements in accordance with the County’s Citizen Participation Plan for amendments to the Consolidated Plan and Annual Action Plans.
