Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This item supports the County Commission’s Goal of Resilient Community of “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”

Amendment 8 (Exhibit 1) modifies the scope of work to assist the County with establishing an ECL along a portion of the shoreline in Pompano Beach, Florida. An ECL must be adopted before the County can conduct any beach renourishment projects in this area. Section 161.141, Florida Statutes, requires an ECL be established in a beach nourishment area as the permanent delineation of the boundary of State-owned submerged lands and lands owned by others. The Florida Department of Environmental Protection (FDEP) requested the County resurvey the 1969 mean high water line for adoption as an ECL. The County must submit the proposed ECL to the FDEP Division of State Lands for presentation to the Board of Trustees of the Internal Improvement Trust Fund.

Section 3.3 of the Agreement provides that the County and Consultant may negotiate additional scopes of services, compensation, time of performance and other related matters for future phases of the Project. Accordingly, the proposed amendment modifies the scope of services in support of the Project, with no change in contract amount.

Details of the agreement history and individual tasks are provided as Exhibit 2.
