Why Action is Necessary

In accordance with Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of 25% for this agreement. Black & Veatch Corporation has committed to 25% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).

 

The purpose of this agreement is to provide Water and Wastewater Services with a planning document that will provide recommendations for improvements to the retail potable water and wastewater system (Exhibit 1). Broward County is in the process of planning for retail potable water and wastewater system improvements through the year 2045. To complete this process, Broward County requires a consultant to prepare a Retail Potable Water and Wastewater Master Plan to address the retail facilities within all four County service areas.

 

The consultant services are covered by Florida Statute Section 287.055, Consultants’ Competitive Negotiation Act (CCNA).

 

The Request for Proposals (RFP) was advertised on August 4, 2023 and, at the time of the submittal deadline on September 21, 2023, two firms submitted proposals in response to the RFP.

 

On November 6, 2023, a Combination Initial and Final Evaluation Committee (EC) Meeting was held. During the EC meeting, the EC passed a motion that determined that all vendors were responsive and responsible to the RFP requirements and would proceed to final evaluation to be numerically scored and ranked by the EC. After presentations, evaluation, scoring, and ranking, the EC named Black & Veatch Corporation as the first-ranked firm.

 

The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from November 8 - 14, 2023, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. There was no additional information submitted within this timeframe.

 

The EC’s final recommendation of ranking was posted on the Purchasing Division website from November 15 - 21, 2023, which provided an opportunity for any aggrieved proposer to file a formal protest.

 

There were no vendor objections, protests, or pulls from the Board for this RFP ranking. On November 22, 2023, in accordance with Procurement Code Section 21.42(k), Procedures for RFPs, RLIs, and RFQs, the ranking of the qualified firms became final, and staff proceeded with negotiations.

 

Three negotiation meetings were held: December 11, 2023; December 13, 2023; and January 8, 2024. The meetings were attended by representatives of Black & Veatch Corporation, the Office of the County Attorney, the Purchasing Division, and Water and Wastewater Services.

 

The term of this agreement is 18 months, effective upon issuance of Notice to Proceed.
