Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT AND THE WATER AND WASTEWATER
SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.
Broward County has provided water and wastewater services since 1962. Initially, these services were provided by the Broward County Utilities Division, which has since been replaced with Broward County Water and Wastewater Services (“WWS”).
In 1963, the Florida Legislature adopted Chapter 63-1181, Laws of Florida, entitled the “Broward County Water and Sewer Act” (Exhibit 1) (the “Special Act”). The Special Act authorizes the Broward County Board of County Commissioners (“Board”), in addition to other specifically conferred powers, to designate, by resolution, one or more areas of operation within the county that are to be served by a water system, a sewer system, or a combined water and sewer system. The Special Act further authorizes the Board to exercise exclusive jurisdiction, control, and supervision of such water, sewer, and combined water and sewer system owned, operated, and maintained by Broward County, as well as to require and enforce the use of such facilities.
In addition, the Special Act authorizes the Board to exclude other utilities from constructing water or sewer facilities within Broward County’s areas of operation.
Currently, Broward County’s areas of operation are serviced by WWS. There are four separate geographic districts within which WWS provides drinking water services: District 1A, District 2A, District 3A, and District 3BC. There are also four separate geographic districts within which WWS provides sewer services: District 1, District 2, District 3A, and District 3BC.
If adopted, this resolution (Exhibit 2) will designate, pursuant to the Special Act, the areas of operation for which WWS is the exclusive provider of a water system (depicted on Exhibit A of Exhibit 3) or of a sewer system (depicted on Exhibit B of Exhibit 3).
