Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Board approval is required for awards exceeding $500,000 inclusive of the value of any renewals or extensions provided for in the contract.

 

In accordance with Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a commercial service airport over the threshold amount provided in § 287.017 for CATEGORY FIVE [i.e., $325,000] as a separate line item on the agenda and must provide a reasonable opportunity for public comment.  Such contracts may not be approved, awarded, or ratified as part of a consent agenda.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT/MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 25% for this contract. Juniper Landscaping of Florida, LLC dba Juniper committed to 25% CBE participation, which has been reviewed and approved by OESBD (Exhibit 2).

 

The purpose of this contract is to provide all labor, materials, equipment, and incidentals necessary for airport grounds landscape and irrigation maintenance at the Broward County Fort Lauderdale-Hollywood International Airport and surrounding grounds for the Broward County Aviation Department (BCAD).

 

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program.  Juniper Landscaping of Florida, LLC dba Juniper has agreed to be bound to the contractual obligations of the Workforce Investment Program.

 

In accordance with the Broward County Living Wage Ordinance, Broward County Administrative Code, Section 26-101(i), these services are covered services. Juniper Landscaping of Florida, LLC dba Juniper has agreed to be bound to the contractual obligations of the Living Wage Ordinance.

 

The apparent low bidder, Grass Roots Complete, LLC, confirmed with BCAD and OESBD that they are unable to meet the 25% CBE goal requirement with their selected CBE subcontractor. BCAD also contends that the firm does not have sufficient references with similar scope of services (Exhibit 4).  Based upon BCAD’s non-concurrence, the Director of Purchasing deemed the apparent low bidder, Grass Roots Complete, LLC, to be non-responsible to the solicitation.

 

Basis of award is for line items 1-24. Line 25 is not applicable to this award. The award amount has been adjusted accordingly by deducting the total price of $300 for Item BLD2123273B1-01-25 from the total bid amount of $639,569 submitted by Juniper Landscaping of Florida, LLC dba Juniper; thereby, resulting in the estimated award amount of $639,269 (Exhibit 1).

 

BCAD reviewed the bid submitted by Juniper Landscaping of Florida, LLC dba Juniper and concurs with the recommendation for award (Exhibit 3). There have been no performance evaluations for Juniper Landscaping of Florida, LLC dba Juniper.

 

The Purchasing Division has researched the prices submitted by the recommended bidder, Juniper Landscaping of Florida, LLC dba Juniper, and determined that the prices submitted are fair and reasonable in comparison to prices of competing firms and the current contract prices (Exhibit 5).

 

Incumbent: Prestige Property Maintenance, Inc.; Contract Number and Title:  BLD2116647B1, Airport Grounds Maintenance Services.  Contract Term:  April 8, 2019 through April 7, 2022.  Expenditures to date:  $993,340.

 

The amounts referenced in this agenda item have been rounded to the nearest whole dollar.

 

The Recommendation for Award was posted on the Purchasing Division website from February 9 - 15, 2022.  There was no protest or appeal filed against this procurement.

 

The bid was posted on October 22, 2021 and opened on November 17, 2021; seven bids were received with no declinations (Exhibit 1).
