Broward County Board of County Commissioners (“Board”) approval is required for the execution of the Fourth Amendment to the Public Transportation Grant Agreement (“PTGA”).

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action allows BCAD to accept additional FDOT grant funding for the Project at FLL.
On April 16, 2019 (Item No. 3), the Board approved the PTGA for Financial Project No. 434832-2-94-01 between Broward County (“County”) and FDOT to fund the Project at FLL. FDOT committed to 50% participation of the Project cost, up to a maximum amount of $12,751,717, and required the County to fund all expenses for the Project in excess of FDOT’s funding, estimated to be in the amount of $12,751,717, while covering any Project cost overruns.
On May 5, 2020 (Item No. 4), the Board approved the First Amendment to the PTGA to provide additional FDOT grant funding up to a maximum amount of $5,000,000, increasing the total Project cost to $35,503,434, thus increasing FDOT’s total grant participation to a maximum amount of $17,751,717.
On April 6, 2021 (Item No. 74), the Board approved the Second Amendment to the PTGA to provide additional FDOT grant funding up to a maximum amount of $1,000,000. increasing the total Project cost to $37,503,434, thus increasing FDOT’s total grant participation to a maximum amount of $18,751,717.
On February 22, 2022 (Item No. 44), the Board approved the Third Amendment to the PTGA to provide additional FDOT grant funding up to a maximum amount of $19,000,000, increasing the total Project cost to $75,503,434, thus increasing FDOT’s total grant participation to a maximum amount of $37,751,717.
The phased funding through this FDOT grant will fund four sub-projects under the main Airport Access Roadway System Project: Short-Term Landside Improvements, Terminal 5 (“T5”) Curbsides and Roadway, Gate 504, and the Supplemental Curb at FLL. The Short-Term Landside Improvements sub-project includes improvements to the Airport Access Roadway System, which is the main roadway through FLL that provides passenger access to all airport terminals and parking garages. The T5 Curbside and Roadways sub-project will add connectivity from the existing Airport Access Roadway to the T5 Curbside and Roadway to transport passengers to the terminal. The new Gate 504 sub-project will provide two entry lanes and one exit lane to facilitate secure access to the restricted Airport Operations Area. The Supplemental Curb sub-project will construct a new supplemental roadway with added terminal curb fronts along Terminals 1, 2, 3, and 4. Approval of the proposed Fourth Amendment to the PTGA grant will allow BCAD to initiate the development of a Project Definition Document that will identify enabling projects, validate the program and prepare a detailed implementation phasing associated with the implementation of the Supplemental Curb sub-project.
The recommended improvements of all four sub-projects will enhance passenger safety on FLL roadways and allow easier access to and from the supporting facilities.
This action approves the proposed Fourth Amendment to the PTGA to provide additional FDOT grant funding up to a maximum amount of $10,000,000, increasing the total Project cost to $95,503,434, and resulting in FDOT’s total grant participation to date in the amount of $47,751,717. The PTGA is phased to allow for future grant opportunities if they become available.
The proposed Fourth Amendment has been reviewed by the Office of the County Attorney. The Fourth Amendment does not include the County's standard agreement provisions as FDOT requires the County to use its form Amendment.
