AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO GARBAGE COLLECTION AND DISPOSAL OF SOLID WASTE; REPEALING SECTIONS 14-78 THROUGH 14-84 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); CREATING NEW SECTIONS 14 78 THROUGH 14-84 OF THE CODE; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
Chapter 14 of the Broward County Code of Ordinances (“Code”) relates to the collection and disposal of garbage in the unincorporated areas and also addresses the issuance of licenses to private trash haulers. Sections 14-78 through 14-83 of the Code were last updated in 1989, and Section 14-84 of the Code relating to the collection of trash in the “Open Market Area” of the unincorporated portions of Broward County has not been updated since its initial enactment in 2011. In the years since these sections were last addressed by the Board, there have been significant changes associated with the trash collection industry.
Solid Waste and Recycling Services recommends that Sections 14-78 through 14-84 of the Code be revised to address the need for updated license agreements with the firms that provide trash hauling services in the unincorporated areas as well as other current conditions impacting garbage collection and disposal.
The proposed Ordinance repeals Sections 14-78 through 14-84 of the Code and replaces them with language reflecting more modern definitions of key terminology relating to the trash collection industry, provides for the Board to be able to establish minimum and maximum collection fees that may be charged to residents in the unincorporated areas, and updates the provisions relating to the issuance of licenses by the County to trash haulers who will operate in the Open Market Area within the unincorporated portions of Broward County.
In addition to this proposed Ordinance, at the same meeting, the Board is also being asked to adopt various amendments to the companion provisions to the Broward County Administrative Code, which, among other things, establish the geographic boundaries of services areas and the Open Market Area within the unincorporated portions of Broward County.
