Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE TRAFFIC ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The City of Coconut Creek is planning to install School Zone Speed Detection Systems (“SD Systems”) within two school zones on Coconut Creek Parkway and one school zone on Wiles Road. Construction plans for the installation of the SD Systems were reviewed and approved by the Broward County Traffic Engineering Division (TED) and the Broward County Highway Construction and Engineering Division (HCED).
The installation of the SD Systems on Coconut Creek Parkway for the Coconut Creek High school zone and the Dave Thomas Education Center school zone and on Wiles Road for the Monarch High school zone are filed under HCED Project Reference Number 241219867.
The SD Systems will be operated and maintained by the City of Coconut Creek Police Department for the purpose of issuing speeding citations to motorists that exceed the speed limit set by the City ordinance authorizing the placement of a speed detection system on a roadway maintained as a school zone.
This item seeks Board approval of a Revocable License Agreement (“Agreement”) between Broward County and the City of Coconut Creek for installation of SD Systems within Broward County right-of-way along Coconut Creek Parkway and Wiles Road in the City of Coconut Creek.
The terms of the Agreement begin upon full execution of the Agreement and extend in perpetuity or until the County terminates the Agreement. The County can terminate the Agreement with or without cause. If the Agreement is terminated, the City must vacate the licensed areas and return them to their original condition.
The Agreement is consistent with Broward County Resolution No. 2025-080 (“Resolution”). The Resolution identified “Grandfathered Cities” which are exempt from the application of Section 2 of the Resolution. The City of Coconut Creek was inadvertently omitted from the list of Grandfathered Cities in the Resolution. Since the City of Coconut Creek enacted its speed detection system ordinance and applied for approval of the SD Systems identified in this item prior to approval of the Resolution, this item will add the City of Coconut Creek to the list of Grandfathered Cities.
The Revocable License Agreement (Exhibit 1) has been reviewed and approved for legal sufficiency by the Office of the County Attorney.
