Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION, AND WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Florida Department of Transportation (FDOT) is undertaking a project to develop and widen the SW 10th Street Connector. Broward County owns, operates, and maintains three County Canals (Canals 1, 2, and 3) within the limits of the SW 10th Street Connector projects. FDOT has requested that FDOT and Broward County enter into a Revocable License Agreement to allow FDOT to perform the necessary canal improvements and to document the responsibilities of both Broward County and FDOT following construction of the SW 10th Street Connector project improvements. FDOT’s project includes canal bank stabilization and extensions and repairs to existing culverts. The improvements to be made will be at FDOT’s sole expense and will not have a financial impact to Broward County. FDOT will also be responsible for repairing, at its sole cost, any damage it causes to the licensed area. The County can terminate the Agreement with or without cause.
The Revocable License Agreement has been reviewed and approved for legal sufficiency by the Office of the County Attorney.
