Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The proposed Resolution (Exhibit 1) allows the County to accept a nonexclusive and perpetual utility easement of variable width located on a portion of Lot 23, Block 1, North Pompano Beach Section “A”, according to the Plat recorded in Plat Book 29, Page 15, together with that portion of Holland Street (also known as N.W. 39th Street) as dedicated by said Plat of North Pompano Beach Section “A” and vacated by Resolution 18-V-72, according to the Official Records Book 5509, Page 835, all of the Official Records of Broward County, Florida.
This item relates to new utilities constructed by a land developer within the Water and Wastewater Services District 2 potable water and wastewater service area under Utility Connection Permit BCUCP-23-013 and transferred to Broward County. This easement is required so that Broward County can install and maintain the water and sewer mains and associated appurtenances serving the public in perpetuity.
The Resolution and utility easement have been reviewed and approved as to form by the County Attorney’s Office.
