Why Action is Necessary
In accordance with Broward County Procurement Code Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that include a single bidder, rejection of apparent low bidder, protested award, or pulls from the Board regarding the intended award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PARKS AND RECREATION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) determined that no County Business Enterprise (CBE) participation goal should apply to this solicitation based on its review of the products and services requested and availability of CBE firms to perform the services (Exhibit 2).
The procurement was solicited in compliance with Federal Procurement Standards, which will enable Broward County to receive Federal Emergency Management Agency (FEMA) reimbursement for utilization of this contract in the event of a declared disaster event.
This contract provides for the purchase and delivery of Federal Emergency Management Agency-compliant (FEMA-compliant) tarps for the Parks and Recreation Division (Parks) and various other Broward County agencies in preparation for and during emergencies and other hazard responses.
The Director of Purchasing determined the apparent low bidder, Horizon ATM LLC (Horizon), to be non-responsible to the bid requirements based on non-compliance with the Specification and Requirements. Parks determined that Horizon does not meet the bid commodity requirements (Exhibit 3).
Parks reviewed the bid submitted by JMI Legacy Manufacturing, LLC (JMI Legacy) and concurs with the recommendation for award (Exhibit 4).
No County vendor performance evaluations have been completed for JMI Legacy.
The Purchasing Division reviewed the prices submitted by the low responsive, responsible bidder JMI Legacy, and has determined that the prices submitted are fair and reasonable in comparison to the previous Broward County contract for these same services (Exhibit 5).
The bid was advertised on December 23, 2024, and opened on January 30, 2025; four bids were received with no declinations (Exhibit 1).
The Recommendation for Award was posted on the Purchasing Division website from May 5 - 9, 2025. There was no protest filed against this procurement.
JMI Legacy’s bid validity expired on May 30, 2025, and JMI Legacy has agreed to extend it through July 31, 2025.
The amounts referenced in this agenda item are rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
The contract consists of the County’s solicitation and the vendor’s response.
The initial contract period begins on date of award.
