Why Action is Necessary
The Broward County Code of Ordinances, Chapter 39 - Zoning, Section 39-413(c)(4) allows the Housing and Urban Planning Division Director to place a site plan on the County Commission agenda for a quasi-judicial public hearing when the Director believes that there is a substantive question regarding the site plan application. That substantive question includes an applicant request to allocate Industrial to Commercial Flexibility, which requires consideration by the Board for a finding of compatibility.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
The Housing and Urban Planning Division has reviewed site plan application 02-SP-25 for proposed self-storage use. The approximately 1.13-acre site is located at 706 Northwest 27 Avenue in the Broward Municipal Services District (BMSD). It is designated Industrial on the BMSD Future Land Use Map and zoned C-1: Commercial Warehouse District (see Exhibits 2 and 4).
The proposed self-storage warehouse is a commercial use that is permitted by the Broward County Comprehensive Plan’s BMSD Element Policy 1.1.1, subject to the allocation of Commercial Flexibility. Allocation of Commercial Flexibility is subject to the requirements of Broward County Land Use Plan (BCLUP) Policy 2.10.1. The Policy provides that the Board of County Commissioners may request a compatibility determination when flexibility is allocated to a site located within 500 feet of Environmentally Sensitive Land (ESL) and that the impact on public schools is adequately considered. The site is located approximately 355 feet west of ESL Site 63: North Fork Blueway. Staff’s review of the request did not find any incompatibility with the nearby ESL. Because the proposed site plan and flexibility request does not include residential, there is no impact on public schools (see Exhibits 1 and 3).
The remaining portions of the requested site plan have been fully reviewed by staff and found to be in compliance with the applicable provisions of Chapter 5 of the Land Development Code and Chapter 39 - Zoning.
