A. MOTION TO APPROVE most reasonable source designation of The School Board of Broward County, Florida, for driver safety and education services in Broward County public and non-public schools for the Broward County Human Services Department.
B. MOTION TO AUTHORIZE County Administrator to execute Agreement No. 24-CP-CSA-0073-01, in substantially the form attached as Exhibit 2 hereto, between Broward County and The School Board of Broward County, Florida, in the estimated amount of $1,946,460 for the initial term, effective October 1, 2023, through September 30, 2026, with two one-year renewal terms, each in the amount of the then-current balance of the Broward County Driver Education Safety Trust Fund, to fund driver education safety programs in Broward County public and non-public schools, with authority to execute subject to legal sufficiency review and approval by the County Attorney’s Office; authorize the County Administrator to execute amendments to the Agreement, subject to legal sufficiency review and approval by the County Attorney’s Office and provided that such amendments do not impose additional financial obligations on the County; and authorize the County Administrator to take all necessary administrative and budgetary actions to implement the Agreement.

Why Action is Necessary
Motion A. In accordance with Broward County Procurement Code Section 21.25, Sole Source Procurement, a sole source procurement above the award authority of the Director of Purchasing must be approved and awarded by the Broward County Board of County Commissioners (“Commission”).
Motion B. A delegation of authority is required for the County Administrator to negotiate and execute agreements.
What Action Accomplishes
Approval of Motions A and B enables the County Administrator to negotiate and execute an agreement between Broward County and The School Board of Broward County, Florida, to fund driver education safety programs in Broward County public and non-public schools using funds collected from traffic violations under the Dori Slosberg Driver Education Safety Act, Section 318.1215, Florida Statutes (Safety Act”).

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.”
Commission approval is requested for the Agreement between Broward County and The School Board of Broward County, Florida (“School Board”) to fund driver education safety programs in accordance with the Safety Act and Section 10-31, Broward County Code of Ordinances. Traffic violation fines in the amount of $5 per violation are collected by the Broward County Clerk of Courts, who then forwards the funds to Broward County for deposit in the Driver Education Safety Trust Fund (“Trust Fund”). The amount payable to the School Board for each year of this program is estimated because the available balance in the Trust Fund is dependent upon the collection of fines for traffic violations. The estimated amount specified for the initial term is the balance of the Trust Fund as of June 30, 2025.
Under applicable law, the funds must be used for the enhancement, not replacement, of driver education safety programs; for direct educational expenses, not administration; and 30 percent of a student’s time in the program must be behind the wheel.
On August 14, 2023, the Director of Purchasing approved a sole source designation of the School Board as the most reasonable source of driver education safety programs in public and nonpublic schools in Broward County (Exhibit 1). The School Board infrastructure allows its driver education safety program to serve students of both public and non-public secondary schools across Broward County. The School Board’s public school driver education safety program, which includes both classroom and behind-the-wheel instruction, has a fleet of over 90 vehicles, and serves over 1,500 students annually. The School Board driver education safety program has been in operation since 2003, and School Board met or exceeded all outcomes in the most recent version of the driver education safety program agreement.
The Agreement (Exhibit 2) is retroactive to October 1, 2023, due to negotiations with the School Board and has two additional one-year renewal terms, with annual funding amounts set at the then-current balance of the Trust Fund. Another version of the agreement was executed by the School Board but that version did not contain certain necessary updates that have been included in the attached Exhibit 2.
