Why Action is Necessary

In accordance with Broward County Procurement Code Section 21.47 (a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided in the contract.

 

Pursuant to Broward County Procurement Code Section 21.27, Purchases from Other Government Contracts, the Director of Purchasing may purchase goods or services under any procurement contract held by a governmental agency or nonprofit entity, or the County may enter into its own contract with the vendor under the originating contract provided that the originating contract was competitively procured, authorizes such purchases, and the terms offered to the County do not materially deviate from the originating contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Connected Community Goal, “Cooperatively delivering an efficient and accessible regional intermodal transportation network.”

 

The Office of Economic and Small Business Development (OESBD) determined that no Disadvantaged Business Enterprise participation goal should apply to this contract based on OESBD’s review of the products (Exhibit 2).

 

The contract provides for the purchase of 65 New Flyer 40-Foot Hybrid Transit Buses under a competitively established Jacksonville Transportation Authority (JTA) contract, for the Broward County Transportation (BCT) Department. These buses will have a minimum expected life of 12 years or 500,000 miles and will be replacing currently operating aging buses that are beyond their useful life in years, mileage, or both.

 

The JTA competitively solicited Request for Proposals (RFP) No. P-23-030, State of Florida Heavy Duty Buses, on January 31, 2024; the RFP closed on May 17, 2024, with two responses received from New Flyer of America, Inc and Gillig, LLC. JTA performed a proposal evaluation, and both responses were determined to be fair, reasonable, and in compliance with the scope and mandatory submittal requirements. Contract No. P-23-030 was awarded to New Flyer of America, Inc. on January 22, 2025, for a five-year term ending on January 22, 2030.

 

The Participating Addendum allows BCT access to pricing, specifications, and contractual terms solicited and awarded in compliance with applicable procurement standards (Exhibit 1).

 

BCT has determined that the JTA contract provides cost-effective pricing and the contract requirements meet the County’s technical specifications (Exhibit 3).

 

The term of the participating addendum begins on date of execution and terminates four years from that date.

The source of funding is Transit Grant Capital and Surtax Capital in the not-to-exceed amount of $85,000,000, over a potential four-year period. The funds estimated for the current Fiscal Year are included in the current Fiscal Year budget.
