Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
On December 19, 1950, Broward County transferred certain real property located in Sunrise, Florida (“Property”) to John D. Kennedy and Elma R. Kennedy, husband and wife, via County Deed Instrument Number 408624, recorded in Official Records Book 716, Page 352, of the Public Records of Broward County. The Deed included certain roadway reservations in favor of the County affecting portions of the Property, including Tract 26, Tract 7, Tract 35, Tract 55, and Tract 56 (collectively, the “Roadway Reservations”).
On March 6, 1997 (Agenda Item No. 3), the Board of County Commissioners approved Resolution No. 1997-0150 releasing a portion of the Roadway Reservations within Tract 35, Tract 55, and Tract 56, determining that the released reservations were no longer needed for County road purposes. The roadway reservations within Tract 26 and Tract 7 remained.
The City of Sunrise, a municipal corporation (“City”), is now the owner of a portion of the Property lying within Tract 7 (“City Property”) and plans to develop the City Property in conjunction with Baptist Health South Florida to build a hospital (“Stated Purpose”). To facilitate development of the City Property for the Stated Purpose, the City has requested that the County release the Roadway Reservation lying within Tract 7 (“Tract 7 Reservation”). County staff determined that the Tract 7 Reservation is no longer needed for County road purposes and the City’s Stated Purpose serves a public purpose and is in the best interest of the County.
The proposed Resolution (Exhibit 1) approves and authorizes the County to execute a Release of Roadway Reservation (Exhibit 2) for the remaining roadway reservation within Tract 7. Exhibit 3 shows the location of the road reservation. The roadway reservation lying within Tract 26 remains.
The proposed Resolution and the Release of Roadway Reservation have been approved as to form by the Office of the County Attorney.
