Summary Explanation/Background

Chapter 2024-210, Laws of Florida, amended Section 177.073, Florida Statutes, to require local governments to develop a process for expediting building permit issuance for residential subdivisions prior to recording of the final plat in the Official Records. Local governments that had such a process in place before July 1, 2023, are required to update their process to provide for the expediting of written applications for up to fifty percent (50%) of the residential building permits.

 

Section 5-187(c) of the Land Development Code, enacted on May 19, 2020, authorized an expedited process for the issuance of building permits prior to plat recordation. This process applies to all permits, including those within a residential subdivision. The proposed Ordinance amends Section 5-187 to formalize portions of the existing process and explicitly list the requirements of the tri-party agreement among the developer, the affected unit of local government, and the County, thereby further expediting the issuance of building permits prior to plat recordation.
