Why Action is Necessary
Motion A: In accordance with the Domestic Partnership Act, Section 16½ -157(c)(8) of the Broward County Code of Ordinances, the Board is authorized to waive the requirements of the Domestic Partnership Act when it is in the best interests of the County.
Motion B: In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that include a single bidder, rejection of apparent low bidder, protested award, or pulls from the Board regarding the intended award.

Provides for anhydrous ammonia, liquid bulk, and anhydrous ammonia tank maintenance services, used in the treatment of potable water, for Water and Wastewater Services.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
The Office of Economic and Small Business Development (OESBD) determined that no County Business Enterprise (CBE) participation goal should apply to this solicitation based on their review of the products and services requested and availability of CBE firms to perform the services.
Section 1-81.3(a) of the Code of Ordinances provides for the setting of a CBE goal of at least 25% unless the Board of County Commissioners or County Administrator (under limited circumstances) approves a different goal, or no goal based upon a written determination by the Director of the Office of Economic and Small Business Development (OESBD). The Board’s approval of this item will result in no CBE goal being set for the applicable agreement consistent with the written determination provided by the Director of OESBD (Exhibit 1).
Motion A of this item seeks to waive the requirements of the Broward County Domestic Partnership Act, per Section 16½ -157(c)(8) of the Code of Ordinances, in order to award this solicitation to Tanner Industries, Inc. Pursuant to the Domestic Partnership Act, Section 16½ -157(c)(8), the Board is authorized to waive the Domestic Partnership Act requirements in the best interests of the County. Tanner Industries, Inc. requests a waiver of the Domestic Partnership Act requirements for this solicitation. Tanner Industries, Inc. (Tanner Industries) states, “As a company we provide benefits to employees and, where applicable, their spouses; however, we do not provide benefits for domestic partners” (Exhibit 4).
Motion B seeks to award a contract for all labor, materials, equipment, and incidentals necessary to provide anhydrous ammonia and anhydrous ammonia tank maintenance services used in the treatment of drinking water at Water and Wastewater Services 1A Water Treatment Plant and 2A Water Treatment Plant. Water treatment anhydrous ammonia is combined with chlorine to produce chloramines for disinfection in the distribution systems for Broward County's Water Treatment Plants.
Water and Wastewater Services has reviewed the bid submitted by Tanner Industries and concurs with the recommendation for award (Exhibit 3).
Two County vendor performance evaluations were completed for Tanner Industries; the vendor has an overall rating of 4.18 out of a possible 5.0. Copies of the vendor performance evaluations are available upon request.
The Purchasing Division reviewed the prices submitted by the low bidder, Tanner Industries, and has determined that the prices submitted are fair and reasonable in comparison to the current Broward County contract for these same services (Exhibit 5).
Incumbent: Tanner Industries, Inc. Contract Number and Title: OPN2119531G1, Anhydrous Ammonia, Liquid Bulk, Contract Term: August 26, 2019, through December 30, 2024, First Renewal: June 30, 2021, through June 30, 2023, Second Renewal: June 30, 2023, through December 30, 2024. Expenditures to date: $332,530.
The bid was advertised on April 4, 2024, and opened on April 19, 2024; two bids were received with no declinations (Exhibit 2).
The Recommendation for Award was posted on the Purchasing Division website from July 3, 2024 through July 12, 2024. There was no protest filed against this procurement.
Tanner Industries’ bid validity expired on August 17, 2024, and Tanner Industries has agreed to extend it through November 8, 2024.
The contract consists of the County’s solicitation and the vendor’s response.
The initial contract period begins on date of award.
