Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 17% for this contract. Gannett Fleming, Inc. committed to 17% CBE participation, which has been reviewed and approved by OESBD (Exhibit 2).

The purpose of this agreement is to provide engineering services for the design of a rehabilitation to Master Pump Station (MPS) 300. Work includes design, permitting, bidding and award assistance, and engineering services during construction to assist Water and Wastewater Services in the delivery of the MPS 300 rehabilitation. The services are covered by Florida Statute Section 287.055, Consultants’ Competitive Negotiation Act (CCNA).

The RFP was advertised on August 15, 2024 and, at the time of the submittal deadline on September 13, 2024, three firms submitted proposals: Ardurra Group, Inc., Gannett Fleming, Inc., and HBC Engineering Company.

On October 31, 2024, an Initial Evaluation Committee (EC) meeting was held. The EC determined that all three firms were responsive and responsible to the RFP requirements and would move forward to the Final EC meeting to be numerically scored and ranked by the EC.

On November 21, 2024, a Final EC meeting was held. After presentations, evaluation, scoring and ranking, the EC deemed Ardurra Group, Inc. as the first-ranked firm; Gannett Fleming, Inc. as the second-ranked firm; and HBC Engineering Company as the third-ranked firm.

Per County’s Local Preference Ordinance (Section 1-74), Gannett Fleming, Inc. and HBC Engineering Company are local businesses. Ardurra Group, Inc. is a nonlocal vendor.

In accordance with Broward County Code of Ordinances Section 1-75(b), (Local preference; procedure), upon the completion of final rankings by the EC, if a nonlocal vendor is the highest-ranked vendor and one or more local businesses are within 5% of the total points obtained by the nonlocal vendor, the highest-ranked local business shall be deemed the highest-ranked vendor overall.

The total score of the local business, Gannett Fleming, Inc., was within 5% of the total score of the nonlocal vendor, Ardurra Group, Inc. Therefore, upon applying the Local Preference Ordinance, the EC deemed Gannett Fleming, Inc. as the first-ranked firm; Ardurra Group, Inc. as the second-ranked firm; and HBC Engineering Company as the third-ranked firm.

The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from November 22 - 27, 2024, which provided an opportunity for any proposer to file an objection. No objection was received.

The EC’s final recommendation of ranking was posted on the Purchasing Division website from December 2 - 6, 2024, which provided an opportunity for any aggrieved proposer to file a protest. No protest was received.

There were no vendor objections, protests, or pulls from the Board for this RFP ranking. On December 9, 2024, in accordance with Procurement Code Section 21.42(f), Procedures for RFPs, RLIs, and RFQs, the ranking of the qualified firms became final, and staff proceeded with negotiations.

Three negotiation meetings were held: January 15, January 27, and January 30, 2025. These meetings were attended by representatives from Gannett Fleming, Inc. and staff the Water and Wastewater Services, the County Attorney’s Office, and the Purchasing Division.

Additional supporting documentation provided to the EC regarding this procurement can be found on the Purchasing Division website at <https://www.broward.org/Purchasing/Pages/Repository.aspx>.

The agreement period begins on the date of award and terminates 18 months from that date.
