MOTION TO AUTHORIZE County Administrator to execute amendments, change orders, and any other required documentation for the Standard Grant Agreement No. 23FRP29 between the Florida Department of Environmental Protection (“FDEP”) and Broward County, dated September 6, 2023 (“Grant Agreement”), for the NE 56th Street Bridge Replacement project, subject to review and approval for legal sufficiency by the Office of the County Attorney, provided that such documents do not impose any additional financial obligation on the County; and to authorize the County Administrator to take any necessary administrative and budgetary actions to implement same.

Board approval is required pursuant to Broward County Administrative Code, Section 20.31.b.3, for the execution of all grant agreements and amendments.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT / HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The requested action supports the Board’s goal of ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.
Grant Agreement No. 23FRP29 (“Grant Agreement”) authorizes a $2,750,000 grant to the County for the NE 56th Street Bridge Replacement project. The funds provided under the Grant Agreement were approved for the project's design, permitting, and construction-related costs. The Grant Agreement requires County matching funds in the amount of $2,750,000. The project is currently in the design phase.
Grant funds were originally allocated by the United States Department of Treasury through the Florida Department of Environmental Protection under the American Rescue Plan Act, but FDEP has informed Broward County that these funds have now been reallocated as state funds on a cost-reimbursement basis. FDEP will require an amendment to the Grant Agreement to update various legal terms to ensure compliance with adopted state laws and the change in funding source.
