Why Action is Necessary
In accordance with Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a large-hub commercial service airport in excess of $1,500,000 as a separate line item on the agenda and must provide a reasonable opportunity for public comment.

Ratifies an Emergency Agreement for the procurement of construction services related to repairs and replacement of Engineered Material Arresting System blocks at Broward County’s Fort Lauderdale-Hollywood International Airport.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
There are no goals assigned to this Emergency Agreement (Agreement) because an emergency procurement is exempt from application of participation goals.
The Engineered Material Arresting System (EMAS) is designed to safely slow and stop an aircraft that has overrun a runway by utilizing beds of crushable concrete blocks placed at the end of the runway. The EMAS beds are required by the Federal Aviation Administration (FAA) as part of Regulatory Standards for the Broward County Fort Lauderdale-Hollywood International Airport (FLL) Airport Operating Certificate. BCAD has contracted with Boland’s LLC, an approved contractor by Runway Safe Inc to perform repair/installation for the EMAS beds. Runway Safe Inc is the only FAA approved U.S manufacturer for EMAS.
On April 9, 2023, a small aircraft overran the east end of the South Runway at FLL and damaged the EMAS bed.
On April 12, 2023, a record “once in a thousand year” storm dropped 25.91 inches of rain that caused flood damages to the east and west end of the North Runway at FLL. The EMAS beds at the east and west ends of the North Runway were deemed damaged beyond repair and would require full replacement. Broward County (County) declared a local emergency and FLL was closed for two days. On April 14, 2023, FLL reopened for business.
On July 19, 2023, the County Administrator approved the emergency procurement for the EMAS repairs and replacement blocks requested by BCAD (Exhibit 2).
Three separate scopes were approved to enable the replacement and repairs: engineering services, EMAS system/materials, and a specialty contractor to remove, repair, and/or install the system. Two agreements - Runway Safe Inc and Boland’s LLC - require ratification in accordance with Florida Statutes requirements for large hub airports.
On March 8, 2024, the Director of Purchasing approved the Agreement between Broward County and Boland’s LLC, in the amount of $1,641,324 (Exhibit 1).

Disaster Recovery for Aviation Fund in the amount of $1,402,468 (subject to Federal Emergency Management Agency (FEMA) reimbursement and FLL Operating Fund in the amount of $238,856 (not subject to FEMA reimbursement).
