C. MOTION TO APPROVE Interlocal Agreement between Broward County and the City of Coconut Creek for the purpose of establishing and implementing joint local housing assistance programs, contingent upon the Local Housing Assistance Plan (LHAP) as provided in Motion A and Motion B; for the term to commence upon execution and run concurrently with the term of the LHAP; authorizing the County Administrator to take any necessary administrative and/or budgetary actions for submission of the Interlocal Agreements to the Florida Housing Finance Corporation for review and approval; and authorize the Mayor and Clerk to execute same.

D. MOTION TO AUTHORIZE County Administrator to execute the Agreement between Broward County and the City of Coconut Creek (City) for Administration by Broward County of the City’s Coronavirus Relief Funds; authorizing the County Administrator to execute any necessary documents to administer the City’s Coronavirus Relief Funds; authorizing the County Administrator to approve and submit a revenue resolution to recognize receipt of the funds, and take all necessary administrative and budgetary actions to include execution and implementation of amendments, reinstatements, project/activity priorities and budgetary changes; subject to final review and approval of form by the Office of the County Attorney.

Why Action is Necessary

Board action is required to approve Resolutions and Agreements for the SHIP Program and for the County to administer the City’s Coronavirus Relief Funds.

 

What Action Accomplishes

Provides the approval for the Board to amend its LHAP to provide for the inclusion of a new city to the LHAP. Provides for the approval of an interlocal agreement between the County and the City of Coconut Creek for the implementation and administration of the City’s SHIP Program, and authorizes submittal of the amended LHAP and executed Interlocal Agreement to the Florida Housing Finance Corporation for it’s review and approval. Authorizes the County Administrator to execute an agreement between the County and the City of Coconut Creek for administration of City’s Coronavirus Relief Funds and authorizes the County Administrator to take all administrative and budgetary actions necessary to facilitate County’s administration of City’s funds.

Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE HOUSING FINANCE AND COMMUNITY REDEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s vision of “A Sustainable, Creative Approach to Community Redevelopment and Housing,” through implementation of the following goals: Goal 1: Facilitate a regional approach to growth and redevelopment through coordination and collaboration at the federal, state, county, and local levels; Goal 2: Strengthen stakeholder partnerships to increase the availability of affordable housing options, including purchase and rental; and Goal 3: Develop, through effective community collaboration, neighborhoods and communities incorporating intermodal connectivity, while integrating energy efficiency and other livability standards and initiatives.

 

The City of Coconut Creek approached the County with a request for the County to implement and administer its SHIP program through an Interlocal Agreement (ILA). Accordingly, the attached ILA (Exhibit 3) is being presented to the Board for consideration and approval. The City’s SHIP allocation for July 1, 2020 is estimated to be $696,533 which will provide the Housing Finance and Community Redevelopment Division with 10% or $69,653 in administrative funds under the ILA. This allocation is now contingent upon the State Legislature budget review in November 2020. Prior to this request from the City of Coconut Creek, the City’s SHIP Program was administered by the Community Redevelopment Associates of Florida, Inc. (CRA). The City terminated its agreement with the CRA December 31, 2019.

 

The LHAP includes the following:

1.                     Program description of strategies.

2.                     Proposed dollar amounts of SHIP funds to be used for each strategy.

3.                     Estimated number of households to be served by income category.

4.                     Estimated number of units to be constructed, purchased, or rehabilitated for each category.

5.                     Establishes maximum allowable purchase price and property assessed value.

6.                     Establishes maximum amount of assistance for each category.

7.                     Proposed administrative expenditures.

8.                     Required certifications to the Florida Housing Finance Corporation.

9.                     Interlocal Agreement to run concurrent with the LHAP for State’s Fiscal Years 2017, 2018, 2019, 2020, 2021, and 2022.

 

Subject to approval of Motions A and B, and following approval of the LHAP and the ILA by the Florida Housing Finance Corporation, Broward County will be eligible to receive, on an annual basis, unanticipated revenue under the SHIP Program to expand or preserve affordable housing in accordance with the approved LHAP, and applicable laws, rules, and regulations governing the SHIP Program.

 

In July 2020, Governor DeSantis announced that additional funding labeled the Coronavirus Relief Funds (CRF) would be provided to eligible local governments.  The City of Coconut Creek is an eligible local government and was therefore allocated $232,500.  The City and the Florida Housing Finance Corporation (FHFC) are entering into a subrecipient agreement for the City’s allocation, and County will be administering the City’s funds subject to the terms of the Agreement between Broward County and the City of Coconut Creek for Administration by Broward County of the City’s Coronavirus Relief Funds. Under the terms of the FHFC subrecipient agreements, all funds allocated pursuant to the CRF must be expended by December 30, 2020.
