On March 5, 2019, the Commission approved the motion authorizing the County to enter into the original ILA (Agenda Item No. 7) and the First Amendment was approved by the Commission on March 14, 2023 (Agenda Item No. 23).
Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING FINANCE AUTHORITY RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Commission’s Goal of “ensuring economic opportunities and a sustainable economy, with an emphasis on Broward's lower and middle class.”
On March 5, 2019, the Commission approved a motion (Item No. 7) authorizing the County to enter into an ILA with the City of Coconut Creek ("City") to provide the City with $640,000 of funding through the Broward Redevelopment Program ("BRP") for public improvements in the Hillsboro Corridor Redevelopment Area (the “Project”), shown in Exhibit 5. The ILA had an initial termination date of September 30, 2023 (Exhibit 2); however, the City requested an extension because the Project experienced delays due to an encroachment. The Commission approved a First Amendment on March 14, 2023, which extended the termination date to March 31, 2026 (Exhibit 3).
In a letter dated January 23, 2026, the City requested an additional one-year extension to the ILA (Exhibit 4). As of the date of the letter, the Project was approximately 75% complete and anticipated to be at 95% completion by the end of February. Although the funds for the project are obligated, the entire scope of work must be completed before funds can be disbursed. The remaining delayed element is the installation of the bus shelters, which were procured through Broward County and are scheduled for delivery and installation on or about July 17, 2026. Therefore, the City requires an extension to complete the remaining scope of work and close out the Project. The Project will continue to advance the BRP objectives of promoting economic development, job creation, and reducing blighting conditions. Accordingly, the Second Amendment (Exhibit 1) was drafted to extend the termination date to March 31, 2027.
This Second Amendment is intended to be the last and final extension of the ILA. No further extensions will be granted. Any BRP grant funds remaining unspent as of the termination date of March 31, 2027, shall be decommitted and returned to the County in accordance with the terms of the ILA.
The County Attorney’s Office has approved the Second Amendment as to form.
