Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL ON THE ABOVE MOTIONS.

 

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 30% for each project.

 

On June 11, 2019 (Item No. 77), the Board of County Commissioners approved Request for Proposals (RFP) No. PNC2119163P1, to select a Managing General Contractor for Broward County Judicial Projects. Described projects include several at the Broward County Judicial Complex (“BCJC”) (downtown campus), the South Garage, the Coca-Cola Building, the South Regional Courthouse replacement project, selected projects at the Main Jail, and various projects within the satellite courthouses.

 

On November 18, 2019, the County Administrator approved the ranking order for RFP No: PNC2119163P1, Managing General Contractor (“MGC”) for Broward County Judicial Projects, and established Stiles Pirtle Joint Venture as the Number One Ranked Firm.

 

On September 22, 2020, the County Administrator approved, by Board Action taken on September 10, 2020 (Item No. 59), the Construction Agreement for Managing General Contractor Services with the Stiles Pirtle Joint Venture. In addition to construction phase services, the services include pre-construction, design and constructability reviews, estimating, scheduling, CBE recruitment and contracting, subcontractor bidding, occupancy assistance and warranty services.

 

On September 21, 2021, the Board approved a First Amendment to the Construction Agreement that increased the funding to the Owner’s Allowance accounts for the projects to allow the County the flexibility, as necessary, to address fluctuations in pricing of construction costs resulting from the ongoing pandemic.

 

On October 11, 2022, the Board approved a Second Amendment to the Construction Agreement that set the Estimated Guaranteed Maximum Price for the South Regional Courthouse Replacement Project.

 

This proposed Third Amendment to the Construction Agreement adds specific enabling projects, such as the demolition of the existing central and west wings and the reconstruction of the west façade of the east building, necessary to be completed prior to the start of construction for the 500-Car Secured Parking Garage and Plaza, to the Construction Agreement at an Estimated Guaranteed Maximum Price of $14,708,910 for these enabling projects.

 

This Third Amendment has been reviewed and approved by the Office of the County Attorney.

Fiscal Impact

Fiscal Impact/Cost Summary

The Estimated Guaranteed Maximum Price (EGMP) for the Enabling Projects for the 500-Car Secured Parking Garage and Plaza is $14,708,910. A portion of the EGMP will be negotiated for pre-construction services as needed.

 

The total estimated cost of the Enabling Projects for the 500-Car Secured Parking Garage and Plaza, inclusive of the EGMP, consultant fees, permit fees, special inspectors and testing services as required by authorities having jurisdiction is approximately $20.1 million. The FY24 Modified Budget for this project is $7,338,000. The balance of funds needed for the Enabling Projects for the 500-Car Secured Parking Garage and Plaza is $12,811,750.

 

The Enabling Projects for the 500-Car Secured Parking Garage and Plaza must be completed prior to the start of construction of the 500-Car Secured Parking Garage and Plaza as well as the start of the full East Wing Renovation. Consequently, the additional $12,811,750 is proposed to be transferred from the East Wing Renovation project to the Enabling Work project to fully fund the project at the $20.1 million estimate. It is anticipated that the $12,811,750 million transferred for this purpose will need to be restored in a future budget action.
