Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE BUILDING CODE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Section 27.187 of the Administrative Code authorizes specified disbursements from the County’s Tree Preservation Trust Fund, which are currently memorialized through Tree Trust Agreements. Under the current process, Tree Trust Agreements require Commission approval.
The proposed Resolution would amend Part XXXIII, Tree Preservation Trust Account, of Chapter 27 of the Administrative Code to authorize the County Administrator to execute Tree Trust Agreements when the proposed disbursement does not exceed $20,000. Disbursements exceeding $20,000 would continue to require Commission approval, consistent with Section 27.187 of the Administrative Code.
The proposed Resolution would create Part XXXI of Chapter 27 of the Administrative Code to authorize the County Administrator, pursuant to Section 40.27a. of the Administrative Code, to execute agreements for the Building Code Division concerning Unsafe Structures, Guaranteed Partial Service, Non-guaranteed Partial Service, Building Code Enforcement, and Zoning Code Enforcement (“Building Code Agreements”).
The Commission would be presented with the proposed Tree Trust Agreement and Building Code Agreements at the time of the public hearing. The proposed Resolution would authorize the County Administrator to execute the Tree Trust Agreements and the Building Code Agreements in a form subject to review and approval as to legal sufficiency by the Office of the County Attorney.
