MOTION TO APPROVE Local Agency Program (“LAP”) Agreement between Florida Department of Transportation (“FDOT”) and Broward County, Financial Project No. 454975-1-68-01, providing federal funding for the partial reimbursement of Construction Engineering and Inspection (“CEI”) services for the rehabilitation of Southwest 7 Avenue bridge over New River (“Project”), with FDOT agreeing to participate in the Project cost up to a maximum amount of $495,000 and Broward County agreeing to bear all expenses in excess of FDOT’s participation; and authorize Director of Highway and Bridge Maintenance Division to approve any amendments to the Agreement that do not increase Broward County’s financial obligations, subject to review and approval by the Office of the County Attorney for legal sufficiency. Why Action is Necessary
A. Approval by the Broward County Board of County Commissioners (Board) is required for the execution of the Local Agency Program Agreement.
B. Board approval is necessary to receive and appropriate unanticipated revenues.
What Action Accomplishes
A. Formalizes the responsibilities of FDOT and Broward County with regard to Project administration and funding of the CEI services necessary to manage the comprehensive rehabilitation of the Southwest 7 Avenue Bridge over New River, and authorizes the Director of Highway and Bridge Maintenance Division to approve any amendments to the Agreement that do not increase Broward County’s financial obligations, subject to review by the Office of the County Attorney for legal sufficiency.
B. Recognizes/appropriates unanticipated revenue funds.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
Broward County is currently preparing construction documents for the rehabilitation of the Southwest 7 Avenue Bridge over New River to enhance the safety, reliability and longevity of the structure. Among other improvements, the bridge will have a barrier wall between vehicular traffic and pedestrians, a solid riding surface over the channel, modern bridge operating systems and controls, and up to current standards pedestrian safety features. The CEI will provide quality assurance, Project administration, technical expertise, documentation and record keeping among other functions.
This item seeks Commission approval of a Local Agency Program Agreement to provide funding from FDOT for the partial reimbursement of CEI services for the rehabilitation of the Southwest 7 Avenue bridge over New River.
Under the Agreement, FDOT agrees to provide funding up to the maximum amount of $495,000. Broward County agrees to bear all expenses in excess of FDOT’s participation. The total estimated cost of the Project is $2,993,531. This item also seeks Commission approval to authorize the Director of Highway and Bridge Maintenance Division to approve any amendments to the agreement that do not increase Broward County’s financial obligations, subject to review by the Office of the County Attorney for legal sufficiency.
The Agreement has been reviewed and approved as to form by the Office of the County Attorney.
The LAP Agreement is an FDOT form agreement that is required to be used. It both contains non-standard provisions that the County does not include in its agreements and is missing certain provisions contained in the County’s standard agreements. These deviations do not impact the legal sufficiency of the LAP Agreement.
