A. MOTION TO AUTHORIZE County Administrator to negotiate a Fourth Amendment to Agreement No. 24-CP-HCS-2199-01 between Broward County and Broward Behavioral Health Coalition, effective October 1, 2025, to update the scope of services and revise the budget for the Agreement; authorize the County Administrator to execute same, subject to legal sufficiency review and approval by the County Attorney’s Office; authorize the County Administrator to execute additional amendments to the Agreement, provided that such amendments do not impose any additional financial obligations on the County and subject to legal sufficiency review and approval by the County Attorney’s Office; and authorize the County Administrator to take all necessary administrative and budgetary actions to implement the Agreement as amended.
B. MOTION TO APPROVE waivers of conflict under Section 112.313(7)(a), Florida Statutes, for the following Broward County advisory board members holding an employment or contractual relationship with an entity receiving funds for the performance of services under this agenda item: Silvia Quintana.

Why Action is Necessary
A. Broward County Board of County Commissioners (“Commission”) approval is required for agreements with external agencies.
B. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.
What Action Accomplishes
Approval of Motion A updates the scope of services and budget for the Broward Behavioral Health Coalition, Inc. (“BBHC”) for diversion services for individuals experiencing mental illness while incarcerated.
Approval of Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The Fourth Amendment enables the revision of Exhibit C-1, Scope of Services for Program #2, Diversion for Mentally Ill Individuals in Jail (DMIJ) and updates Exhibit C-3, Budget and Reimbursement.
On January 23, 2024 (Item No. 16), the Commission authorized the County Administrator to execute an Agreement with Broward Behavioral Health Coalition, Inc. (“BBHC”) to provide improved community reintegration through comprehensive care coordination for mental health treatment, substance abuse treatment, and community-based peer support services to arrested individuals with serious mental illnesses and/or co-occurring substance use disorders who are charged with a second- or third-degree felony, (“Post Arrestee Jail Diversion Program”). On June 10, 2025, the Commission also approved an increase in funding to BBHC to add a recurring program (Program #2) for diversion services for individuals experiencing mental illness while incarcerated (“Diversion for Mentally Ill Individuals in Jail”).
On September 16, 2025, during the Fiscal Year 2026 Adopted Operating Budget Meeting, the Commission approved operating expenses for both the Post Arrestee Jail Diversion Program and the Diversion for Mentally Ill Individuals in Jail programs, in the amount of $1,500,000, effective October 1, 2025.
This item requests Commission approval to revise the scope of services to shift the population of focus for Program #2, Diversion for Mentally Ill Individuals in Jail, from supporting individuals in jail for a felony conviction to supporting individuals with mental health or substance use disorders who are in jail due to a misdemeanor conviction at the request of BBHC. Revision of the budget in Exhibit C-3 of the Agreement will allow the program budget to align with the program activities during the Fiscal Year.
This Fourth Amendment will be reviewed and approved as to form by the County Attorney’s Office.
Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which... is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached as Exhibit 1 and constitutes full disclosure of any existing conflict.
