MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on August 20, 2026, at 10:00 a.m., in Room 422 of Governmental Center East to consider adoption of a proposed Resolution Amending the Broward County Administrative Code, the title of which is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO EMPLOYEE RETENTION; AMENDING SECTION 26.44 OF THE BROWARD COUNTY ADMINISTRATIVE CODE (“ADMINISTRATIVE CODE”) TO COMPLY WITH SECTION 218.077, FLORIDA STATUTES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

The Broward County Charter requires the posting of notice and a public hearing for adoption of amendments to the Broward County Administrative Code.

Summary Explanation/Background
During the 2024 Legislative Session, the Florida Legislature enacted Chapter 2024-80, Laws of Florida, which amended Section 218.077, Florida Statutes, effective September 30, 2026. As amended, Section 218.077 prohibits political subdivisions from imposing certain wage and employment benefit requirements through procurement and contracting procedures for contracts entered into on or after September 30, 2026, but allows those requirements to continue for contracts entered into prior to that date.
The proposed Resolution, if adopted, would amend Section 26.44 of the Administrative Code to provide that employee retention requirements will no longer apply to County contracts for the Fort Lauderdale-Hollywood International Airport entered into on or after September 30, 2026.
