Summary Explanation/Background

Chapter 3½ of the Code requires that a Certificate of Public Convenience and Necessity (“Certificate”) be obtained from the County prior to a person, firm, corporation, or association providing Basic Life Support (“BLS”) services within Broward County.

Nonemergency medical transportation services play a critical role in protecting public health and safety. Current regulatory classifications and Certificate structures may not adequately reflect the unique operations and needs of small businesses in connection with the opportunity to provide ambulance service. The creation of a Class 6 Certificate would promote access and ensure that small businesses are able to operate and grow their businesses while providing safe and reliable BLS services.

The Class 6 Certificate would include eligibility criteria tailored to small businesses, such as fleet size, revenue thresholds, and other operational and compliance requirements. It is currently anticipated that the number of Class 6 Certificates available would be limited in number.

The Class 6 Certificate would not allow entities to respond to 911 or emergency calls, transport to emergency departments for acute medical care, or perform any form of Advanced Life Support (ALS) services.

This item would direct the County Attorney’s Office to prepare an amendment to Chapter 3½ of the Code, for the Board’s subsequent consideration, to create a Class 6 Certificate for small businesses.
