Why Action is Necessary

In accordance with 1-88(d) of the Broward County Code of Ordinances, the Board of County Commissioners (“Board”) may, in its sole discretion, reduce, eliminate, or waive any or all the public art appropriations on a project-by-project basis.

 

What Action Accomplishes

Approves an increase in the compensation to the artist, which increases the overall project costs.

Summary Explanation/Background

THE BROWARD COUNTY CULTURAL DIVISION, AND THE BROWARD COUNTY CULTURAL COUNCIL RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board's value of cultivating community culture, arts, recreation, and life-long learning.

 

On November 10, 2020 (Item No. 54) the Board approved artist Vicki Scuri and her conceptual design proposal for the Andrews Avenue Bridge Project for an amount not to exceed $490,000. The artist subsequently withdrew from the Project.

 

On April 6, 2021 (Item No. 49) artist Susan Narduli’s conceptual artwork design proposal was approved by the Board for Andrews Avenue Bridge. The budgeted amount for the project was $490,000.

 

During the design development phase of the public art project the artist’s engineering team determined that the existing electrical supply was insufficient to power the conceptual artwork design. An increase in the project budget from $490,000 to $615,000 to bring the necessary power to the bridge was approved by the Public Art & Design Committee on March 8, 2023, and by the Broward Cultural Council on April 4, 2023. The additional $125,000 needed to complete the project was appropriated by the Board as part of the County’s Fiscal Year 2024 Capital Budget approved on September 19, 2023.

 

On October 6, 2023, artist Susan Narduli advised the Cultural Division that the subcontractor’s bids for fabrication and installation of the artwork design were above the amount budgeted. The agreement between Broward County and Susan Narduli requires that the artist redesign the artwork at no cost to the County when the cost exceeds the available budget. However, the Cultural Division determined that the artist’s proposed modifications would diminish the impact of the artwork and were therefore not acceptable.

 

An increase in the project budget from $615,000 to $670,000 due to the escalating cost of fabrication and installation was approved by the Public Art & Design Committee on January 10, 2024, and by the Broward Cultural Council on February 1, 2024.
