Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Housing and Urban Planning Division has received a request to vacate and annul a 12-foot utility easement lying within a portion of Parcel C and D of Googe Plat No. 1 plat, as recorded in Plat Book 136, Page 15 of the Official Records of Broward County, Florida, generally located on the south side of Northwest 38 Street, between Northwest 9 Avenue/Powerline Road and Interstate 95, in the City of Oakland Park. Vacating these easements will provide clear and unencumbered title to the property owner.

The City of Oakland Park passed and adopted Resolution 2026-056 on May 6, 2026, granting approval of the vacation. Review of this application by the applicable reviewing agencies indicates that there is no objection to the vacation of the subject easement.

This vacation application has been reviewed and approved as to form by the Office of the County Attorney (Exhibit 1). This vacation application has been publicly noticed ten days prior to the hearing date and will be noticed ten days after the hearing date, in a newspaper of general circulation in Broward County, pursuant to Section 125.66, F.S. and Section 336.10, F.S., as applicable.
