MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on June 9, 2026, at 10:00 a.m., in Room 422 of Governmental Center East to consider enactment of a proposed Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO ELEVATOR OUTAGES; AMENDING AND RENUMBERING VARIOUS SECTIONS OF CHAPTER 21 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); CREATING SECTION 21-10 OF THE CODE, ESTABLISHING ELEVATOR REPAIR REQUIREMENTS FOR MULTISTORY RESIDENTIAL BUILDINGS; AMENDING SECTION 8½-16, RELATING TO CIVIL PENALTIES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Applicable law requires the publication of notice and a public hearing for enactment of amendments to the Broward County Code of Ordinances (“Code”).

Enables the setting of a public hearing during which the Board of County Commissioners (“Commission”) may consider enacting the proposed Ordinance.

Summary Explanation/Background
Extended elevator outages in multistory buildings significantly restrict mobility, access to essential services, and emergency egress, negatively affecting all residents and disproportionately affecting seniors and persons with disabilities. This Ordinance will require building owners and condominium associations to establish and post emergency protocols for dealing with elevator outages, including plans for assisting those with mobility limitations during outages, and for contacting other elevator service providers if their current provider is unable to fix the outage within a reasonable amount of time. The Ordinance also provides for enforcement mechanisms.
