Summary Explanation/Background

THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

On August 22, 2017 (Item No. 41), the Board of County Commissioners approved the License and Concession Agreement between Broward County and Florida Renaissance Festival, Inc. (RenFest), for Florida Renaissance Festival at Quiet Waters Park, granting a license to utilize portions of Quiet Waters Park to hold an annual series of renaissance festivals (each annual series, an “Event”).

On January 28, 2020 (Item No. 27), the Board approved a First Amendment to the Agreement to allow the sale of liquor at the Event.

On September 9, 2021 (Item No. 34), the Board approved a Second Amendment to the Agreement exercising the optional five-year renewal term provided in the Agreement, extending the term through the conclusion of the 2027 Event.

On November 15, 2022 (Item No. 55), the Board approved a Third Amendment to the Agreement to increase the number of weekends for each yearly Event from seven to eight per year; authorize the Contract Administrator to approve up to an additional three weekends for the yearly Event (for a maximum total of up to 11 weekends per year); update provisions of the Agreement required by recent changes to applicable law.

On October 22, 2024, pursuant to delegated authority under the Broward County Procurement Code, the Parties entered into a Fourth Amendment to the Agreement to modify the set-up period for each annual Event by permitting RenFest to commence set-up activities up to 27 days prior to the first weekend of each annual Event, subject to prior written approval from the Contract Administrator, and to update related provisions regarding park access and responsibility for personal property during the set-up period.

RenFest requested an extension to the Agreement to allow for the continuity of services of the Event beyond the expiration term of August 2027. The Fifth Amendment extends the term of the Agreement for an additional five years, distinguishes between tickets sold, tickets scanned, and complimentary season tickets issued by RenFest, and addresses applicable tax-related obligations.
