MOTION TO APPROVE Director of the Cultural Division to solicit funding in excess of $30,000 to offset County’s cost for the Project, and to execute funding-related agreements for the referenced funding, subject to review for legal sufficiency by the Office of the County Attorney; and to authorize the County Administrator to take all necessary and budgetary actions to implement same.

Why Action is Necessary
A. The Fiscal Year 24 capital budget includes $2,000,000 from the Public Art & Design (PAD) Trust Fund and the Tourist Development Tax (TDT) Capital Fund. Broward County Code of Ordinances requires the Broward County Board of County Commissioners (“Board”) approve the artist’s design proposal when the budget for the artwork is $100,000 or more.
B. Board action is required to approve Advantage Marketing Program solicitations in excess of $30,000.
What Action Accomplishes
This action approves the Artist’s design proposal for the Project, approves the overall Project budget, and authorizes the Cultural Division to solicit funding under Advantage Marketing to offset the cost to County for the Project.

Summary Explanation/Background
THE BROWARD COUNTY CULTURAL DIVISION, THE BROWARD COUNTY CONVENTION AND VISITORS BUREAU, THE OFFICE OF PUBLIC COMMUNICATIONS, AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Board's Healthy Community Goal of cultivating community culture, arts, recreation, and life-long learning and the Connected Community Goal of prominently marketing Broward County as a brand, while increasing public understanding of programs and services.
On May 10, 2023, a Limited Call to Artists was issued to four artists specializing in lighting design. The Limited Competition method of artist selection is used when a public art project has very specific requirements. Artist Tracey Dear was selected by the Artist Selection Panel on August 8, 2023, and by the PAD Committee on September 13, 2023.
Exhibit 1 (which is subject to change) is the proposed Project budget. The total cost for the entire Project is estimated to be $6,000,000. Exhibit 2 is the proposed artistic lighting design by the artist. The theme of the artistic design is “Everyone Under the Sun & Everyone Under the Stars.” In addition to the daily light display, the lights will be programmed to change color to mark specific holidays or events. The artistic lighting design will be visible from numerous locations including the Greater Fort Lauderdale Convention Center (“Convention Center”), the new Convention Center headquarters hotel, boats and water taxis traversing the Stranahan River, Port Everglades, and the riverfront.
The space under the west side of the bridge will be activated with artistic elements which will facilitate foot traffic between the Convention Center and hotels on the north side of the bridge and create a space for cultural events. The bridge lighting and the artistic activations are anticipated to create a safe environment for pedestrians and contribute to the economic vitality of the area.
The E. Clay Shaw, Jr. Bridge is the property of the Florida Department of Transportation (FDOT). FDOT’s Community Aesthetic Feature program (CAF) allows agencies to request permission to place public art within the right-of-way that benefits the public, results in positive economic development, and increases tourism. FDOT staff have reviewed the design proposal and provided preliminary approval to install the lighting on the bridge.
This item, if approved, will approve the Artist’s design proposal, approve the Project budget, and allow the Director of the Cultural Division to seek funding to offset the cost of the Project to the County. Contributors to the Project may be recognized through plaques placed near the bridge, in promotional materials, or may be invited to attend events such as ribbon cuttings to celebrate completion of the Project.

Fiscal Impact/Cost Summary
The total cost for the entire Project is estimated to be $6,000,000. Existing budgeted funds are comprised of $599,000 ($212,000 appropriated in FY23 and $387,000 appropriated in FY24) within the PAD Trust Fund, and $1,401,000 has been appropriated with TDT funds in FY24. The remaining $4,000,000 is anticipated to come from future County appropriations and non-County sources resulting from fundraising efforts.
