A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners at its meeting of October 6, 2020.

Summary Explanation/Background

Chapter 26 of the Broward County Administrative Code requires that contractors and subcontractors providing certain services at the Fort Lauderdale-Hollywood International Airport ("Airport") pursuant to a contract with a term greater than six months comply with certain worker retention requirements.  The smooth and continuous operation of Airport services is important to the viability and growth of the Airport.  Broward County has a proprietary interest in ensuring that Airport services are not disrupted, as such disruption would disserve the public.  In addition, Broward County gains significant revenue from the Airport, and disruption of operations could result in a loss of Airport revenue.

 

At its June 4, 2019, meeting (Agenda Item 66), the Board directed staff to recommend changes to the worker retention requirements at the Airport to clarify the requirements for hiring incumbent employees and the required notice that must be provided to the County and the successor contractor or subcontractor.  The proposed amendments were prepared by the Office of the County Attorney in consultation with Airport staff and other stakeholders.

 

The proposed amendments, if adopted, would require contractors and subcontractors to provide specific employee information to their successors prior to the expiration or termination of an applicable contract.  The proposed amendments would also clarify the requirement that successor contractors and subcontractors offer employment to the incumbent employees and the information that must be provided to the County if the successor contractors or subcontractors do not hire the incumbent employees.

 

The Board adopted the Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code at its meeting of October 6, 2020.
