MOTION TO AUTHORIZE County Administrator to negotiate and execute a Second Amendment to the Transportation Surtax Interlocal Agreement among the County, Broward Metropolitan Planning Organization (MPO), and participating Municipalities (Transportation Surtax ILA), addressing the matters stated on Exhibit 1 and any materially related matters, provided the amendment does not create any new financial obligation for the County and subject to review for legal sufficiency by the Office of the County Attorney; and to authorize the County Administrator to negotiate and execute any associated amendment to the Interlocal Agreement for Transportation Surtax Services between the County and the MPO (MPO ILA) to ensure consistency between the MPO ILA and the Transportation Surtax ILA, subject to review for legal sufficiency by the Office of the County Attorney.

Summary Explanation/Background
On August 21, 2018, the Board approved the Transportation Surtax ILA committing at least 10% of available annual surtax revenues to municipal projects (inclusive of community bus service) and providing for the MPO to review, rank, and prioritize municipal capital projects. The Transportation Surtax ILA was subsequently amended to, among other things, address the different processes for reviewing municipal capital projects and municipal rehabilitation and maintenance projects.
The MPO ranked and recommended funding for designated phases (e.g., planning, design, or construction) of 110 municipal capital projects, 97 of which were considered statutorily eligible. The funding required for those 97 projects will exceed the County’s surtax funding obligation through Fiscal Year 2025 (the end of the County’s current Five-Year Plan). The Board also allocated additional funding for 40 municipal rehabilitation and maintenance projects.
The Transportation Surtax ILA needs to be amended including to incorporate new processes developed to ensure that surtax funds are expended as efficiently as possible and in a manner that minimizes unnecessary delays and inconvenience to the public. Exhibit 1 lists the primary business points to be addressed. This item would authorize the County Administrator to also address materially related points in the amendment, provided they do not create any new financial obligation for the County. This item would also authorize the County Administrator to negotiate and execute any amendment to the MPO ILA necessary or appropriate to conform that agreement to the amendments to the Transportation Surtax ILA.
All resulting documents would be subject to review as to legal sufficiency by the Office of the County Attorney.
