B. Section 5339, Bus and Bus Facilities Formula Grants, in the amount of $3,799,484 under the Federal Transit Act, reauthorized under the Infrastructure and Investment Jobs Act; authorizing the County Administrator, or written designee, to furnish the FTA with additional information that may be required for FTA review and consideration of the grant application; authorizing the County Administrator, or written designee, to execute a grant award agreement under this grant program and to sign any and all other documentation that may be required in connection with the grant application or award, subject to review and approval of the grant agreement and other documentation for legal sufficiency by the Office of the County Attorney; authorizing the County Administrator to take all necessary administrative and budgetary actions to implement the grant; and providing for an effective date.

 

C. MOTION TO ADOPT budget Resolution to amend the Fiscal Year 2025 Transit Capital Grant Fund for the Transportation Department, to increase the budget amount by $11,973,926.

 

D. MOTION TO ADOPT budget Resolution to amend the Fiscal Year 2025 Transit Capital Grant Fund for the Transportation Department, to increase the budget amount by $993,294.

Why Action is Necessary

A & B. Broward County, FL, as the grant applicant and recipient of federal financial assistance, is required by the U.S. Department of Transportation to take official action to authorize the County Administrator, or written designated personnel, to execute and file necessary grant applications and all FTA-required documents for Federal assistance on the FTA’s internet-based grant system.

 

C & D. Pursuant to Florida Statutes Section 129.06(2)(d), revenue requires Board action by Resolution to accept and allocate the funds.

 

What Action Accomplishes

Increases capital funding allocated to the Transportation Department for Fiscal Year 2025 Federal Transit Administration (FTA) capital assistance projects by a total of $12,967,220.

Summary Explanation/Background

THE TRANSPORTATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the Board’s Connected Community Goal of "Cooperatively Creating an Efficient and Accessible Regional Intermodal Transportation Network" by providing additional capital funding to improve and enhance the transit system.

 

As part of the Bipartisan Infrastructure Law, public transportation assistance funds from the Federal Transit Administration (FTA) are distributed by formula to the “Miami Urbanized Area,” (Miami UZA) consisting of Miami-Dade, Broward, and Palm Beach counties. Grant programs identified within this agenda item include: 5307 Urbanized Area Formula and 5339 Bus and Bus Facilities.

 

FTA Section 5307 programs fund eligible costs associated with: purchasing buses and non-revenue support vehicles, preventative maintenance, maintenance and rehabilitation of transit and passenger facilities, construction, communications, security, and transit enhancements (e.g., bus stop infrastructure, computer hardware and software). The 5339 program funds replace, rehabilitate and purchase buses and related equipment, as well as construct bus-related facilities. The formula allocation is based on a combination of factors including: bus revenue vehicle miles, bus passenger miles, fixed guideway revenue vehicle miles, fixed guideway route miles, high-intensity bus systems using high-occupancy vehicle lanes, population and population density and number of low-income individuals.

 

The Resolutions (Exhibits 1 and 2), if adopted by the Board, authorize action by the County Administrator or her written designee to facilitate the submission of the required applications for these grants, the provision of necessary information to the Federal Transit Administration, and execution of the grant award agreements and other documents necessary to accept the grant funds (subject to review of such agreements for legal sufficiency by the Office of the County attorney). Exhibits 4 and 5 provide budget resolutions to increase the grant capital budget by $12,967,220.

 

Letters sent to the FTA Region 4 Administrator signed by the South Florida Regional Transportation Authority (SFRTA/TriRail), PalmTran, Broward County Transit (BCT), and Miami-Dade Transit, outline the total allocation for the Miami UZA and the allocation to each entity based on FTA's formula for the grants (Exhibit 3). The 2025 FTA 5307 and 5339 apportionments to Broward County totals $49,170,580 and increases BCT’s adopted Fiscal Year 2025 capital budget by a total of $12,967,220.

 

These FTA 5307 and 5339 grant allocations for Fiscal Year 2025 represent a total increase of $1,437,288 to Broward County Transit from Fiscal Year 2024.
