Summary Explanation/Background
On June 2, 2020, the Board amended the Local Preference Ordinance, including to modify the definitions of local businesses and locally based businesses that qualify for certain preferences. Pending the Board’s consideration in the upcoming months of a comprehensive amendment to the Broward County Procurement Code (“Procurement Code”), this interim amendment to the Procurement Code is presented for the Board’s consideration to incorporate the June 2020 amendments to the Local Preference Ordinance into the Procurement Code as the operative method of determining a vendor’s principal place of business for the purpose of breaking ties.
Section 21.31 of the Procurement Code provides the criteria for breaking ties between vendors, including based upon whether the vendor is a local vendor, but states the requirements for a local vendor in a substantively different manner than is set forth in the Local Preference Ordinance, as recently amended. The proposed Resolution, if adopted, would incorporate the definitions of “local business” and “locally based business” from the Local Preference Ordinance, as amended, as the applicable definitions for the local vendor tiebreaker criteria, and would also clarify the calculation of the vendor’s dollar volume of work previously awarded by the County as exclusive of amounts paid to County Business Enterprises (CBEs).
