Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47(a) and Section 21.53 (a)(1) the Board shall make all awards, and authorize the execution of associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided in the contract and approve any additional extension period beyond five years.
What Action Accomplishes
Extends the term of the contract and provides additional funding during the extension period for bus tire leasing services for the Transportation Department (BCT) to allow time for the completion of the procurement process for the replacement contract.

Summary Explanation/Background
THE TRANSPORTATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The purpose of Contract No. TRN2118573B2, Bus Tire Leasing Services, is to provide the Broward County Transportation Department (BCT) the ability to lease tires and obtain related bus tire installation services for the tires used on the fixed-route bus fleet. The proposed second amendment will extend the contract for six additional months to allow time for the completion of the procurement process for a replacement contract. The proposed second amendment also increases the unit prices, due to changing market conditions, and increases the maximum not-to-exceed amount in the contract by $834,173.
As background, the Director of Purchasing awarded Bid No. TRN2118573B2, Bus Tire Leasing, to Michelin North America beginning March 17, 2020, for an initial two-year term with three one-year renewal terms for a total not-to-exceed contract value of $5,576,668. On March 30, 2022, the agreement was amended by the Director of Purchasing to provide for price adjustments and increase the unit prices based upon market conditions for an amended not-to-exceed contract value of $6,087,778. The agreement was subsequently renewed and expires June 14, 2025. This second amendment (Exhibit 1) is necessary to allow time for the completion of the procurement process for the replacement contract while ensuring essential transit services are not disrupted. The maximum amount for all goods and services provided under the amended agreement will be increased from $6,087,778 to $6,921,195.
The proposed second amendment has been reviewed and approved as to form by the County Attorney’s Office.
