The term of this agreement will be retroactive from February 11, 2022 through October 1, 2024.

In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Board approval is required for awards exceeding $500,000.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT/SEAPORT ENGINEERING AND CONSTRUCTION DIVISON RECOMMEND APPROVAL OF THE ABOVE MOTION.
This action supports the Board’s Goal to increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs.
The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 25%. Bermello, Ajamil & Partners, Inc. committed to 25% CBE participation (Exhibit 2).
The purpose of this agreement is to provide professional design and consulting services to perform design, permitting, and construction support services for interior and exterior improvements, contract administration, construction engineering, and construction inspection at Broward County Port Everglades Cruise Terminal 4 and adjacent Berth 4.
In order to meet the contractual deadline for completion of approved plans by August 1, 2022 as outlined in the Passenger Cruise Terminal and Berth User Agreement with Disney Cruise Line, work was required to start on February 11, 2022; therefore, requiring a retroactive approval of this agreement.
On September 9, 2021 (Item No. 55), the Board approved Request for Proposals (RFP) No. PNC2123285P1, Design and Consulting Services for Cruise Terminal 4 and Berth Improvements.
On December 1, 2022, a combination Initial and Final Evaluation Committee meeting was held. The Evaluation Committee determined that all four firms were responsive and responsible to the RFP requirements. After vendor presentations, the Evaluation Committee evaluated, scored, and ranked the firms with Bermello, Ajamil & Partners, Inc. as the first-ranked firm.
The Evaluation Committee’s proposed recommendation of ranking was posted on the Purchasing Division website from December 9 - 13, 2021, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. The Evaluation Committee’s final recommendation of ranking was posted on the Purchasing Division website from December 14 - 20, 2021, which provided an opportunity for any aggrieved proposer to file a formal protest. No objection or protest was received.
Two negotiation meetings were held to negotiate an agreement with Bermello, Ajamil & Partners, Inc.: February 3 and February 8, 2022. These negotiation meetings were attended by representatives of Bermello, Ajamil & Partners, Inc., staff from the Seaport Engineering and Construction Division, the County Attorney’s Office, and the Purchasing Division.
