Summary Explanation/Background
On October 6, 2026, the County Commission considered Item 14, which proposed adoption of a Resolution relating to the potential sale of real property titled in the name of the County identified by Folio No. 4842-2112-0050 and commonly referred to as “Alpha 250” (“Property”). The item did not receive majority approval.
Motion A asks the County Commission to renew consideration of Item 14 from the October 6, 2026, agenda. County Commission rules require majority approval to renew consideration of the same item within six months after it was first considered.
Motion B is contingent upon majority approval of Motion A. If Motions A and B are both approved, the proposed Resolution will be adopted. The Public Works and Environmental Services Department and the Real Property and Real Estate Development Division recommended and continue to recommend approval of Motion B.
Motion B is summarized as follows:
Broward County is the owner of the Property, a vacant and undeveloped parcel of land that is approximately 22 acres in size and located on Blount Road, north of West Copans Road, in the City of Pompano Beach, Florida. The Property is zoned General Industrial, I-1/PCI - Planned Industrial Overlay, under the City of Pompano Beach zoning code.
In June 2015, the County and certain municipalities located within the County entered into a Settlement Agreement resolving litigation styled City of Sunrise, et al. v. Broward County, Seventeenth Judicial Circuit Court Case No. CACE-13-015660, relating to the 1986 Interlocal Agreement for Solid Waste Disposal Services. The Settlement Agreement, as amended (“Settlement Agreement”), governs, among other matters, the sale of the Property.
Pursuant to the Settlement Agreement, the County and the municipalities are contractually required to use their best efforts and take all reasonable steps to sell the Property. The net proceeds from the sale of the Property will then be distributed to the twenty-one municipal parties to the Settlement Agreement and four additional consenting municipalities in accordance with the Settlement Agreement.
Pursuant to the Settlement Agreement, as amended and approved by the County Commission and the elected bodies of the twenty-one settling municipalities, the deadline for the County to begin taking reasonable steps toward the sale of the Property was extended to October 11, 2026. The Settlement Agreement requires the County to conduct the sale process by sealed competitive bid to the highest responsive and responsible bidder, with input regarding the solicitation specifications from the Mayors of Fort Lauderdale, Hollywood, Miramar, Sunrise, and Weston (“Five Municipal Mayors”), and in accordance with Section 1-4 of the Broward County Code of Ordinances and applicable Florida law.
The proposed Resolution authorizes the Real Property and Real Estate Development Division to proceed with and manage the sealed competitive bid process in the manner provided for in the Settlement Agreement.
If Motion B is approved, the next steps would be as follows:
1. The County will obtain input on the solicitation specifications from the Five Municipal Mayors.
2. The County will publish the competitive solicitation to identify the highest responsive and responsible bidder.
3. Once the sealed bids are opened, the County will provide the results to the Five Municipal Mayors. If a majority of the Five Municipal Mayors timely object to the sale price as insufficient, the County must reject the bids and conduct a second bid process between 12 and 18 months later.
4. If the Five Municipal Mayors approve the result of the competitive solicitation, the proposed sale will be submitted to the County Commission for consideration.
5. Following the conclusion of the competitive solicitation process, the County has a “right of first refusal” to elect to retain the Property by paying the net amount that otherwise would have been distributed from the sale.
Approval of this Resolution does not constitute approval of a purchaser, purchase and sale agreement, quitclaim deed, or sale of the Property. Prior to the completion of the sale process, should the County, the 21 settling municipalities, and four additional consenting municipalities seek to extend the sale, an additional amendment to the Settlement Agreement may be executed to do so. Any sale or other disposition of the Property will be presented to the Board in a subsequent agenda item only upon completion of the required sale process under the Settlement Agreement.
